【摘要】：同性婚姻是近年來一個(gè)具有爭(zhēng)議性的話題,越來越多的國家開始頒布一些相關(guān)法律保護(hù)同性戀群體的權(quán)利。英國《同性婚姻法》的通過標(biāo)志著英國成為了世界上第二十個(gè)允許同性結(jié)婚的國家。在其立法歷程中,有三個(gè)關(guān)鍵節(jié)點(diǎn)：第一是1957年的沃芬敦報(bào)告,報(bào)告指出同性親近行為并不是一種疾病,任何成年人之間,在自愿情況下,私下進(jìn)行的親密行為不應(yīng)被裁定為犯罪；第二個(gè)節(jié)點(diǎn)是英國2004年通過的《民事伴侶法》,該法案賦予同性伴侶締結(jié)民事伴侶的權(quán)利；最后一個(gè)法案是2013年通過的《同性婚姻法》,從此英國的同性戀群體也可以締結(jié)婚姻關(guān)系。本文的重點(diǎn)是分析推動(dòng)英國同性婚姻立法社會(huì)因素。論文首先的梳理了從古代到二十世紀(jì)初的同性權(quán)利保障的發(fā)展,簡(jiǎn)單分析了推動(dòng)沃芬敦報(bào)告進(jìn)展的社會(huì)原因。推動(dòng)2004年《民事伴侶法》的因素有國外因素和國內(nèi)因素。國外因素包括歐洲其他國家的立法先例對(duì)英國的影響以及美國的同性戀權(quán)益運(yùn)動(dòng)對(duì)英國社會(huì)整體的影響；國內(nèi)因素包括英國類似石墻組織的同性戀群體組織的努力以及英國一些同性戀名人的效應(yīng)。最后分析了影響2013年《同性婚姻法》的因素,包括首相卡梅倫的政治目的以及防范艾滋病的蔓延和惡化。盡管現(xiàn)在同性戀群體已經(jīng)融入主流文化,許多國家也已經(jīng)將保護(hù)同性戀群體權(quán)利提上議程,但是前路仍然有很多艱難險(xiǎn)阻。論文希望英國同性婚姻的立法過程對(duì)其他國家保護(hù)同性戀群體權(quán)益有一些借鑒作用。
[Abstract]:Same - sex marriage is a controversial topic in recent years , and more and more countries have begun to enact laws to protect the rights of gay groups . In its legislation , there are three key nodes : first , the 1957 Wolfenton report , which states that same - sex marriage is not a disease , and that , under voluntary circumstances , intimate conduct should not be adjudicated as a crime ;
The second node is the Civil Partnership Act , adopted in 2004 by the United Kingdom , which grants the right to a civil partnership with a sexual partner ;
The last act is the same - sex marriage law adopted in 2013 , and the gay community in Britain can also conclude the marriage relationship . The focus of this paper is to analyze the social factors that promote same - sex marriage legislation in Britain . First of all , this paper analyzes the social reasons for promoting the progress of gay marriage legislation in Britain . The factors include foreign factors and domestic factors . Foreign factors include the influence of legislation precedents of other European countries on Britain and the influence of gay rights and interests in the United States on the whole British society .
Domestic factors include the efforts of gay community groups similar to stone - wall organizations in the UK and the effects of some gay celebrities in Britain . Finally , the factors that affect gay marriage laws in 2013 , including the political ends of Prime Minister Cameron and the spread and deterioration of AIDS , have been analysed . Despite the fact that gay groups are already in mainstream culture , many countries have also put the rights of gay groups on the agenda , but there are still a lot of difficulties ahead . The paper hopes that the legislative process of same - sex marriage in Britain has some reference to protecting gay rights and interests in other countries .
