【摘要】：家庭暴力現(xiàn)象自古皆有,非當(dāng)下之獨(dú)有,在全世界都存在,縱向上蔓延時(shí)間長,橫向上分布范圍廣。但是從啟蒙運(yùn)動開始,婦女消除性別差異的意識開始萌芽,直到19世紀(jì)婦女運(yùn)動進(jìn)入全盛時(shí)期。在國際環(huán)境的有利影響下,我國從1996年開始注重家庭暴力防治,這次思想風(fēng)暴從部分地區(qū)擴(kuò)展到全國,歷時(shí)20年,終于在2016年3月,我國第一部反家庭暴力法頒布實(shí)施。謹(jǐn)以此為背景,本文致力于探討《中華人民共和國反家庭暴力法》(下稱反家庭暴力法)亮點(diǎn)與長處,同時(shí)結(jié)合這一年多法律實(shí)踐中暴露出來的問題,并根據(jù)我國婚姻家庭方面、弱勢群體保障方面、性別歧視消除方面的實(shí)際情況,對家庭暴力的法律救濟(jì)提出針對性的意見,全文共分三大部分:第一章是關(guān)于家庭暴力問題概述。本章主要探討家庭暴力的基礎(chǔ)問題,家庭暴力概念、主體以及形式,分析反家庭暴力法關(guān)于家庭暴力概念界定的不合理之處,同時(shí)分析我國家庭暴力的法律救濟(jì)體系,分析優(yōu)勢與缺陷所在;第二章在第一章討論的家庭暴力問題本身所獨(dú)有的特殊性的基礎(chǔ)上,提出解決家庭暴力問題應(yīng)該遵循的基本原則,作為指導(dǎo)和改進(jìn)家庭暴力防治體系的理論基礎(chǔ);第三章在前兩章指出了現(xiàn)實(shí)并提出了原則的基礎(chǔ)上,從弱勢群體本身的需要、反家庭暴力法的完善以及其他相關(guān)制度的配合上,提出針對性的意見。
[Abstract]:The phenomenon of domestic violence has existed since ancient times and is not unique to the present. It exists all over the world and has a long time of vertical spread and a wide range of horizontal distribution. But since the Enlightenment, women's awareness of eliminating gender differences began to sprout, until the 19th century when the women's movement entered its heyday. Under the favorable influence of the international environment, China began to pay attention to the prevention and treatment of domestic violence in 1996. This ideological storm spread from some areas to the whole country. It took 20 years, and finally in March 2016, the first anti-domestic violence law was enacted and implemented in our country. Against this background, this paper is devoted to discussing the bright points and strengths of the Anti-domestic violence Law of the people's Republic of China (hereinafter referred to as the Anti-domestic violence Law), at the same time combining with the problems exposed in the legal practice of more than one year, and according to the marriage and family aspects of our country. The protection of vulnerable groups, the actual situation of the elimination of gender discrimination, the legal relief of domestic violence put forward targeted opinions, the full text is divided into three parts: the first chapter is an overview of domestic violence. This chapter mainly discusses the basic problems of domestic violence, the concept, the subject and the form of domestic violence, analyzes the unreasonableness of the definition of domestic violence in anti-domestic violence law, and analyzes the legal relief system of domestic violence in our country. Chapter two, based on the unique particularity of domestic violence itself discussed in Chapter 1, puts forward the basic principles to be followed in solving the problem of domestic violence. As the theoretical basis of guiding and improving the prevention and control system of domestic violence, the third chapter points out the reality and puts forward the principle in the first two chapters, from the needs of the vulnerable groups themselves, the perfection of anti-domestic violence law and the cooperation of other relevant systems. Put forward targeted opinions.
