【摘要】：隨著我國(guó)房地產(chǎn)經(jīng)濟(jì)的升溫,不少家庭難以負(fù)擔(dān)高漲的房?jī)r(jià),以按揭方式購(gòu)房漸漸成為大多數(shù)家庭的首選,另一方面,在離婚時(shí)面臨的房產(chǎn)分割問(wèn)題是按揭房越來(lái)越多,如何合理公平的分割的按揭房也是法院在判案的遇到的棘手問(wèn)題。《婚姻法》司法解釋三自公布以后這幾年來(lái),解決了不少現(xiàn)實(shí)中離婚房產(chǎn)分割存在的各地判案不一致的問(wèn)題,也提供了法律依據(jù),但是在按揭房分割的問(wèn)題上的規(guī)定少之又少,可操作性也不強(qiáng),不論是實(shí)際操作還是審判時(shí),都在一定程度上面臨著《物權(quán)法》和《婚姻法》在適用上的沖突,同時(shí)在司法解釋條文中,也存在著適用矛盾。本文立足于實(shí)踐,在選取兩個(gè)案例的基礎(chǔ)上,引出在離婚按揭房分割的所面臨的焦點(diǎn)問(wèn)題,并按出資對(duì)象不同的標(biāo)準(zhǔn),分為夫妻出資和父母出資兩種情況遇到的問(wèn)題加以討論,在對(duì)比各方觀點(diǎn)的基礎(chǔ)上給出筆者自己的觀點(diǎn)。最后針對(duì)出資不同的兩類按揭房分割的問(wèn)題,給出相應(yīng)的完善建議。第一章是按揭房分割的概述,主要從離婚按揭房分割的前提、特點(diǎn)和原則三個(gè)方面作了簡(jiǎn)單介紹,為后面引出所要討論的問(wèn)題做出鋪墊。第二章從夫妻出資和父母出資兩個(gè)角度分別討論這兩種按揭房由于出資不同在分割中各自遇到的問(wèn)題,從法律沖突、法條理解和實(shí)際操作等幾個(gè)方面歸納總結(jié)了爭(zhēng)議點(diǎn)。第三章根據(jù)上一章提出的爭(zhēng)議點(diǎn)提出完善建議,前兩小節(jié)對(duì)夫妻出資的法律規(guī)定的細(xì)化和父母出資的法條的完善提出具體建議,最后一節(jié)針對(duì)實(shí)踐中出現(xiàn)的問(wèn)題提出完善舉措。
[Abstract]:With the heating up of the real estate economy in our country, many families are unable to afford the soaring housing prices, so buying a house by way of mortgage has gradually become the first choice for most families. On the other hand, when the real estate is divorced, there are more and more mortgage houses. How to divide the mortgage room in a reasonable and fair manner is also a thorny problem that the court has encountered in the adjudication of the case. Since the publication of the judicial interpretation of the Marriage Law, in the past few years, it has solved the problem of inconsistent judgments in many places where the division of divorced real estate exists in reality. It also provides a legal basis, but there are very few regulations on the issue of the division of mortgage housing, and they are not very operational, whether in actual operation or in trial. To a certain extent, both of them are confronted with conflicts in the application of the Real right Law and the Marriage Law, and at the same time, there are also contradictions in the application of the articles of judicial interpretation. This paper is based on practice, on the basis of selecting two cases, leads to the focus of the divorce mortgage housing division, and according to the different standards of the object of investment, divided into two kinds of cases of husband and wife funding and parents to discuss the problems encountered. On the basis of comparing the views of the parties, the author gives his own views. Finally, in view of the problem of two kinds of mortgage housing division with different investment, the paper gives the corresponding perfect suggestions. The first chapter is an overview of the division of mortgage housing, mainly from the divorce mortgage housing segmentation premise, characteristics and principles of three aspects to make a brief introduction, for the problems to be discussed in the following to make a foreshadowing. The second chapter discusses the problems in the division of the two kinds of mortgage housing from the perspectives of husband and wife contribution and parents' contribution respectively, and summarizes the controversial points from the aspects of conflict of laws, understanding of law articles and actual operation. The third chapter according to the controversy proposed in the previous chapter put forward suggestions to improve the first two sections of the husband and wife contribution of the law and parents to improve the provisions of the specific recommendations the last section for the practice of problems proposed to improve measures.
