【摘要】： 作為國際上第一部關(guān)于兒童權(quán)益保護的法律文件,1989年的《兒童權(quán)利公約》涉及了兒童的眾多權(quán)利,涵蓋了兒童的生命權(quán)、生存與健康權(quán)、家庭權(quán)利、社會權(quán)利、司法權(quán)利以及特殊兒童的保護等幾乎所有涉及兒童人權(quán)的領(lǐng)域,明確將子女最佳利益原則作為關(guān)于處理兒童事務(wù)的主要原則。子女最佳利益原則現(xiàn)已發(fā)展成為世界許多國家處理涉及子女事務(wù)時的最高準則。 目前,在我國涉及兒童事務(wù)的法律制度中,并沒有確立子女最佳利益原則。筆者認為,我國不僅要確立子女最佳利益原則,而且要在涉及兒童權(quán)益的法律制度中實踐這一原則所體現(xiàn)的保護兒童權(quán)利的精神,尤其要在關(guān)乎兒童眾多權(quán)益的監(jiān)護制度中,更是要以此原則為指導(dǎo)。因此,本文立足于我國監(jiān)護制度的現(xiàn)實,通過比較國外監(jiān)護制度中關(guān)于子女最佳利益原則的立法狀況,指出我國監(jiān)護制度的立法缺陷,建議我國《婚姻法》、《民法通則》等法律引入子女最佳利益原則,并且依據(jù)子女最佳利益原則提出了完善監(jiān)護制度的立法建議。
[Abstract]:As the first international legal document on the protection of the rights and interests of the child, the 1989 Convention on the Rights of the Child deals with many rights of the child, covering the child's right to life, survival and health, family rights, and social rights.The principle of the best interests of the child is explicitly regarded as the main principle in dealing with children's affairs in almost all fields involving the human rights of children, such as the right to justice and the protection of special children.The principle of best interests of children has developed into the highest standard in many countries in the world.At present, the principle of best interests of children has not been established in the legal system of children's affairs in China.The author believes that China should not only establish the principle of the best interests of children, but also practice the spirit of protecting children's rights in the legal system concerning children's rights and interests, especially in the guardianship system which concerns the rights and interests of children.It is even more important to use this principle as a guide.Therefore, based on the reality of the guardianship system in our country, this paper points out the legislative defects of the guardianship system of our country by comparing the legislative situation of the principle of the best interests of the children in the foreign guardianship system.It is suggested that "Marriage Law", "General principles of Civil Law" and other laws introduce the principle of best interests of children, and put forward legislative suggestions to perfect guardianship system according to the principle of best interests of children.
