【摘要】：家務(wù)勞動是家庭存續(xù)的重要方式,家務(wù)勞動作為一種私人勞動總是和婦女聯(lián)系在一起的,婦女一直以來都是家務(wù)勞動的主體。家務(wù)勞動的繁重性與無償性嚴(yán)重阻礙女性進(jìn)入社會生產(chǎn)領(lǐng)域,限制女性的發(fā)展,并成為引發(fā)家庭矛盾的重要原因。從法學(xué)的角度來看,必須使家務(wù)勞動的經(jīng)濟(jì)價值在立法上給予承認(rèn),肯定并保護(hù)家務(wù)勞動的價值。我國在2001年修訂的《婚姻法》設(shè)立了家務(wù)勞動補(bǔ)償制度,我國婚姻法規(guī)定的家務(wù)補(bǔ)償制度雖然對于解決司法實(shí)踐中存在的付出較多家務(wù)勞動的夫妻一方在離婚時不能在經(jīng)濟(jì)上獲得合理評價的問題,填補(bǔ)法律空白,具有一定的積極意義,但這一規(guī)定仍然在適用范圍、適用根據(jù)、適用形式和適用限制等方面存在缺陷。為此,我國在立法、司法和法律監(jiān)督等方面對實(shí)現(xiàn)家務(wù)勞動價值保護(hù)的現(xiàn)實(shí)需求是應(yīng)該及時調(diào)整和完善的。 本文試從法律與社會的視角作為切入點(diǎn)進(jìn)行研究,旨在找出一個最佳結(jié)合點(diǎn),呼喚立法充分切實(shí)保障婦女婚姻家庭權(quán)益,從立法上保障婦女婚姻家庭權(quán)益。本文將從以下幾個方面展開分析和研究:一、序言,這一部分主要講述選題的原因、研究的意義以及研究方法;二、家務(wù)勞動的基本問題,這一部分主要介紹家務(wù)勞動的有關(guān)概念,家務(wù)勞動的價值問題等;三、分析國內(nèi)外現(xiàn)有理論對女性家務(wù)勞動價值保護(hù)的理論支持以及理論中的不足之處;四、女性家務(wù)勞動價值保護(hù)的立法建議,將立足于我國的相關(guān)法律規(guī)定,結(jié)合國外以及我國臺灣地區(qū)的可取做法探討家務(wù)勞動價值的保護(hù)在我國立法中的現(xiàn)實(shí)實(shí)現(xiàn)并提出結(jié)論。
[Abstract]:Domestic work is an important way for the family to survive. As a kind of private work, domestic work is always associated with women, and women have always been the main body of domestic work.The heavy and unpaid domestic work seriously hinders women to enter the field of social production, restricts the development of women, and becomes an important cause of family conflicts.From the point of view of law, the economic value of domestic work must be recognized in legislation, and the value of domestic work must be affirmed and protected.The Marriage Law, which was amended in 2001, established a compensation system for domestic work.Although the domestic compensation system stipulated in the Marriage Law of our country can solve the problem that one of the husband and wife who pay more housework in judicial practice can not get a reasonable economic evaluation at the time of divorce, it can fill the legal gap.It has some positive significance, but it still has some defects in the scope of application, the basis of application, the form of application and the limitation of application.Therefore, our country should adjust and perfect the realistic demand of realizing the value protection of domestic work in the aspects of legislation, judicature and legal supervision.This paper tries to study from the angle of view of law and society in order to find out the best combination point and call for legislation to protect the rights and interests of women's marriage and family and to protect the rights and interests of women's marriage and family through legislation.This article will carry on the analysis and the research from the following several aspects: first, the preface, this part mainly narrates the reason which the topic chooses, the research significance and the research method; second, the domestic work basic question,This part mainly introduces the related concepts of domestic work, the value of domestic work, etc. Third, it analyzes the theoretical support of domestic and foreign existing theories to protect the value of female domestic work and the deficiencies in the theory. 4.The legislative suggestions on the protection of the value of female domestic work will be based on the relevant laws and regulations of our country, and the practical realization of the protection of the value of domestic work in the legislation of our country will be discussed in combination with the desirable practices in foreign countries and Taiwan area of our country, and the conclusion has been put forward.
