【摘要】：夫妻財(cái)產(chǎn)制是規(guī)范夫妻財(cái)產(chǎn)關(guān)系的法律制度,涉及夫妻財(cái)產(chǎn)的歸屬(取得)、變動(dòng)、權(quán)利行使、債務(wù)承擔(dān)、清算與分割等多個(gè)環(huán)節(jié),每一個(gè)環(huán)節(jié)都可能與財(cái)產(chǎn)法規(guī)則產(chǎn)生沖突。理論界和實(shí)務(wù)界較為關(guān)注的沖突主要在五個(gè)方面:在財(cái)產(chǎn)歸屬方面、物權(quán)變動(dòng)方面和權(quán)利行使方面夫妻財(cái)產(chǎn)制與物權(quán)法規(guī)則的沖突,在夫妻債務(wù)認(rèn)定、夫妻間贈(zèng)與問題上夫妻財(cái)產(chǎn)制與合同法規(guī)則的沖突。前兩個(gè)沖突是表面上的沖突而非實(shí)質(zhì)性沖突,針對(duì)婚姻內(nèi)部即夫妻之間的財(cái)產(chǎn)關(guān)系,應(yīng)當(dāng)適用婚姻法的夫妻財(cái)產(chǎn)制。第三和第四個(gè)沖突是實(shí)質(zhì)性沖突,而且是法律本身的沖突,針對(duì)婚姻外部即夫妻與第三人的關(guān)系,應(yīng)當(dāng)適用財(cái)產(chǎn)法規(guī)則。最后一個(gè)沖突也是實(shí)質(zhì)性沖突,但不是法律本身的沖突,而是法律適用中的沖突,應(yīng)根據(jù)不同情況作出不同的選擇。
[Abstract]:The property system of husband and wife is a legal system that regulates the relationship between husband and wife's property. It involves the ownership (acquisition, change, exercise of rights, debt commitment, liquidation and division) of husband and wife's property. Each link may conflict with the property law rules. The conflicts that the theorists and the practitioners pay more attention to are mainly in five aspects: the property ownership, the property rights change and the right exercise, the conflict between the property system and the property law rules. The conflict between the property system of husband and wife and the rules of contract law on the issue of husband and wife's debt determination. The first two conflicts are superficial conflicts rather than substantive conflicts, aiming at the property relationship between husband and wife within the marriage. The third and fourth conflicts are substantive conflicts, and they are conflicts of the law itself, with regard to the relationship between husband and wife and the third person outside the marriage, Property law rules should be applied. The last conflict is also a substantive conflict, but not a conflict of the law itself, but a conflict in the application of the law, and different choices should be made according to different circumstances.
