【摘要】：在我們的生活中，雖然“同性戀”這個詞匯不常被提起，但它在醫(yī)學(xué)、社會學(xué)以及法律上卻有著極其重要的意義。從上古的原始社會開始，，歷經(jīng)奴隸社會、封建社會，直到今天，同性戀一直都是非常普遍的一個社會現(xiàn)象。但是在不同的國家，人們對同性戀和同性性行為的態(tài)度差別甚大，歐洲同性戀者的生活環(huán)境十分壓抑，而亞洲則相對寬松。但是隨著人類社會的不斷發(fā)展，同性戀由罪惡到病理再到正常，最終由受到歧視和壓迫而轉(zhuǎn)變?yōu)楂@得認(rèn)可、得到保護。進入到21世紀(jì)以后，同性戀者在法律上的地位逐漸提高，也獲得了許多其他的權(quán)利，比如有權(quán)追求屬于自己的幸福生活，在新的時代背景下，同性戀者更加著眼于如何實現(xiàn)同性婚姻的合法化，他們的目標(biāo)就是能夠?qū)崿F(xiàn)法律認(rèn)可的自由結(jié)合。經(jīng)過一定時間的發(fā)展，對于同性婚姻在得到認(rèn)可的同時，許多伴侶制度以及伴侶結(jié)合模式也得到發(fā)展。當(dāng)前，在世界上的許多國家中，都制定法律對于同性戀者的婚姻權(quán)利進行了保障，雖然給予同性戀者的權(quán)利保護程度并不一樣，保護的方式也是不一而同，但是都體現(xiàn)出了對于同性戀者相關(guān)權(quán)利的重視與關(guān)注，這對于同性婚姻今后的發(fā)展具有極其重要的意義和作用。 針對當(dāng)前的發(fā)展現(xiàn)狀，結(jié)合我國實際情況，對同性婚姻進行研究，是時代發(fā)展的需要，也對社會、法律提出了更高的要求。作為世界大國，我國的同性戀現(xiàn)象是不可避免的問題，同性戀者在我國占據(jù)著相當(dāng)大的比例，加之我國人口基數(shù)大，同性戀者的數(shù)量更是不容忽視，這是需要解決的一個重大社會問題。鑒于此，我國必須要從法律層面來保障同性戀者的合法權(quán)利，必須制定相關(guān)的法律制度，建立健全保障機制，充分保障同性戀者的合法權(quán)利。本文的寫作思路大致如下：首先，從這一問題的背景入手，樹立明確的研究目的，挖掘此次研究的重要意義，進而提出本文的創(chuàng)新之處。其次，認(rèn)真、細(xì)致地分析同性婚姻的相關(guān)概念、歷史成因以及表現(xiàn)形式等，為進一步的行文提供理論基礎(chǔ)。再次，筆者對學(xué)者們關(guān)于同性婚姻的理論觀點和家庭關(guān)系進行討論，并從倫理和法學(xué)兩個角度來論述同性婚姻的正當(dāng)性。最后，他山之石，可以攻玉，筆者會選取一些具有代表性的國家的立法進行分析，在汲取經(jīng)驗的情況下，討論如何構(gòu)建我國的同性婚姻制度。
[Abstract]:In our lives, although the term "homosexuality" is not often mentioned, it has great significance in medicine, sociology and law. To this day, homosexuality has been a very common social phenomenon. But in different countries, attitudes towards homosexuality and same-sex sex are very different, and the living environment of homosexuals in Europe is very depressing. Asia is relatively loose. But with the development of human society, homosexuality changes from crime to pathology to normality, from discrimination and oppression to recognition and protection. After entering the 21st century, The legal status of homosexuals has gradually increased, and many other rights have been obtained, such as the right to pursue their own happy lives, and in the new era, homosexuals are focusing more on how to legalize same-sex marriage. Their goal is to be able to achieve legally recognized free association. After a certain period of development, while same-sex marriage is recognized, many partnership systems and patterns of partnership are also developed. In many countries in the world, laws are enacted to guarantee the marriage rights of homosexuals, although the degree of protection of the rights of homosexuals is different, and the way of protection is also different. However, they all reflect the importance and concern of gay related rights, which is of great significance and effect to the development of gay marriage in the future. According to the current development situation and the actual situation of our country, the research on same-sex marriage is the need of the development of the times, and it also puts forward higher requirements to the society and the law. As a big country in the world, Homosexuality is an inevitable problem in our country. Homosexuals occupy a large proportion in our country. In addition, the population base of our country is large, and the number of homosexuals can not be ignored. This is a major social problem that needs to be solved. In view of this, our country must protect the legal rights of homosexuals from the legal level, must formulate relevant legal systems and establish a sound safeguard mechanism. The main ideas of this paper are as follows: first, starting with the background of this problem, setting up a clear purpose of research, excavating the significance of this study, and then putting forward the innovation of this paper. The related concepts, historical causes and manifestations of same-sex marriage are carefully and carefully analyzed to provide a theoretical basis for further writing. Thirdly, the author discusses the scholars' theoretical views on same-sex marriage and family relations. And from the two angles of ethics and law to discuss the legitimacy of same-sex marriage. Finally, another mountain stone, can attack the jade, the author will select some representative countries to analyze the legislation, in the case of learning experience, This paper discusses how to construct the system of same-sex marriage in China.
