【摘要】：在我國,夫妻之間應(yīng)該適用一般的侵權(quán)行為法。為了檢驗(yàn)這一立場是否妥當(dāng),有必要考察發(fā)達(dá)資本主義國家的相關(guān)制度。英美法系國家的制度可以分為三個(gè)歷史階段:夫妻之間侵權(quán)豁免,為保護(hù)女方的個(gè)人財(cái)產(chǎn)而適用一般的侵權(quán)行為法,夫妻之間全面適用一般的侵權(quán)行為法,大陸法系國家分為兩種模式:絕大多數(shù)國家適用一般的侵權(quán)行為法;少數(shù)國家在部分領(lǐng)域免除了輕過失的責(zé)任。
[Abstract]:In our country, the general tort law should be applied between husband and wife.In order to test the appropriateness of this position, it is necessary to examine the relevant systems of developed capitalist countries.The system of Anglo-American legal system can be divided into three historical stages: exemption from tort between husband and wife, general tort law to protect the personal property of the woman, and general tort law between husband and wife.Civil law countries are divided into two models: the vast majority of countries apply general tort law, and a few countries exempt from liability for minor negligence in some areas.
