【摘要】：19世紀(jì)后期，美國社會處于轉(zhuǎn)型時期，社會發(fā)生劇變。之前適用于農(nóng)業(yè)社會的法律，已經(jīng)無法滿足迅速變化的社會需求。盛行于一時的法律形式主義在美國遭到猛烈攻擊。推崇法律實(shí)用主義的卡多佐以實(shí)用主義為基礎(chǔ)，順應(yīng)社會變化的法律生長理論產(chǎn)生了�？ǘ嘧粽J(rèn)為法律必須穩(wěn)定，但是，面對不斷變化的社會，法律和社會之間就會出現(xiàn)脫節(jié)的情況。所以，法律不能靜止不變，法律需要生長�？ǘ嘧舻姆缮L理論是一種實(shí)用主義的法律理論，雖然是普通法國家法律生長的經(jīng)驗，但作為一種實(shí)用主義思想，有值得我們借鑒之處。 當(dāng)代中國社會正處于一個前所未有的社會轉(zhuǎn)型時期，社會正發(fā)生翻天覆地的變化，隨著人民生活水平的不斷提高，夫妻財產(chǎn)狀況呈現(xiàn)日益復(fù)雜化和多樣化的趨勢。夫妻財產(chǎn)復(fù)雜化和多樣化，，導(dǎo)致離婚財產(chǎn)分割成為雙方當(dāng)事人爭議最多的部分。雖然，我國2001年重新修訂了《婚姻法》，最高人民法院又于2001年12月27日頒布施行了《關(guān)于適用(中華人民共和國婚姻法)若干問題的解釋(一)》，但仍然不能適應(yīng)夫妻財產(chǎn)關(guān)系的多變性和復(fù)雜性。對此，2004年和2011年最高人民法院又頒布施行了《婚姻法司法解釋（二》）和《婚姻法司法解釋（三）》。雖然新的婚姻法和司法解釋，對夫妻離婚財產(chǎn)分割的相關(guān)條款進(jìn)行了完善。但是，現(xiàn)實(shí)生活紛繁復(fù)雜，面對社會經(jīng)濟(jì)快速的發(fā)展，法律總會出現(xiàn)滯后及“真空地帶”。所以，本文選定對離婚財產(chǎn)分割方面的相關(guān)問題研究，以達(dá)到對夫妻離婚財產(chǎn)分割的法律制度進(jìn)一步完善。 作為社會關(guān)系和社會生活重要組成部分的婚姻關(guān)系，包含的內(nèi)容十分廣泛，并且隨著社會的不斷發(fā)展，物質(zhì)生活條件的改善，思想文化觀念的變化，婚姻家庭關(guān)系也在不斷發(fā)展變化。這就需要有完善的婚姻家庭法律規(guī)范來加以調(diào)整，以穩(wěn)定婚姻家庭生活，使社會平穩(wěn)向前發(fā)展。同時，隨著調(diào)整對象的不斷發(fā)展變化，婚姻家庭法律規(guī)范也需要發(fā)展完善，以滿足社會發(fā)展變化的需求。而法律的生長完善是一種漸進(jìn)的過程，并受到社會經(jīng)濟(jì)條件、傳統(tǒng)文化和政治制度以及道德習(xí)慣等其他相關(guān)制度因素的影響。本文將從法律生長的視角，采用歷史分析和比較研究的方法，著重分析我國人民政權(quán)下的離婚財產(chǎn)分割制度的生長過程，港澳臺地區(qū)離婚夫妻財產(chǎn)分割制度之比較，以及影響離婚財產(chǎn)分割制度的因素和法律生長理論對我國離婚夫妻財產(chǎn)分割制度的啟示。
[Abstract]:In late 19th century, American society was in a period of transition, and society changed dramatically. No longer able to meet the rapidly changing needs of society. The prevailing legal formalism has come under fierce attack in the United States. Cardoso, who advocates legal pragmatism, is based on pragmatism. The theory of legal growth that responds to social change has emerged. Cardoso believes that law must be stable, but in the face of changing societies, there is a disconnect between law and society. Therefore, the law cannot remain static. Law needs to grow. Cardoso's theory of law growth is a kind of practical legal theory, although it is the experience of common law countries' law growth, but as a kind of pragmatism thought, we should draw lessons from it. The contemporary Chinese society is in an unprecedented period of social transformation, and the society is undergoing earth-shaking changes, with the continuous improvement of the people's living standards. The situation of marital property is becoming more and more complicated and diversified. The complication and diversification of marital property result in the division of divorced property into the most controversial part of the two parties. In 2001, China revised the Marriage Law, and on December 27th 2001, the Supreme people's Court promulgated and put into effect the interpretation (1) of some issues concerning the Application of the Marriage Law of the people's Republic of China, but still could not adapt to the property of husband and wife. In response to this, the Supreme people's Court promulgated and implemented the Judicial interpretation of the Marriage Law (II) and the Judicial interpretation of the Marriage Law (3) in 2004 and 2011. The article about the division of divorce property between husband and wife has been perfected. However, the real life is complicated, and in the face of the rapid development of society and economy, the law always lags behind and has a "vacuum zone". In order to perfect the legal system of divorce property division, this paper chooses the related problems of divorce property division. Marriage, as an important part of social relations and social life, contains a wide range of contents, and with the continuous development of society, the improvement of material living conditions, the change of ideology and culture, Marriage and family relations are also developing and changing. This requires perfect legal norms on marriage and family to be adjusted in order to stabilize marriage and family life and make society develop smoothly. At the same time, with the continuous development and changes of the objects of adjustment, The legal norms of marriage and family also need to be improved to meet the needs of social development and change. The growth and perfection of the law is a gradual process and subject to social and economic conditions. The influence of traditional culture, political system and other relevant institutional factors, such as morality and custom. This paper will adopt the method of historical analysis and comparative study from the perspective of legal growth. Focusing on the analysis of the growing process of divorce property division system under the people's power in China, and the comparison of divorce couple property division system in Hong Kong, Macao and Taiwan, And the influence factors of divorce property division system and the theory of legal growth to the divorce couple property division system enlightenment.
