【摘要】：贍養(yǎng)老人,是中華民族的傳統(tǒng)美德,也是贍養(yǎng)義務(wù)人應(yīng)盡的法律義務(wù)。隨著經(jīng)濟(jì)和社會的發(fā)展,人們生活水平不斷提高,但不少贍養(yǎng)義務(wù)人卻把贍養(yǎng)老人看作是額外負(fù)擔(dān),不僅不提供老人基本生活所需,甚至虐待、遺棄老人。隨著我國進(jìn)入老齡社會,我國贍養(yǎng)糾紛層出不窮。然而我國現(xiàn)行法律對于贍養(yǎng)問題的規(guī)定比較模糊和籠統(tǒng),缺乏可操作性,致使老年人的合法權(quán)益得不到應(yīng)有的保護(hù)。筆者認(rèn)為老年人贍養(yǎng)法律制度的研究,對于保護(hù)老年人合法權(quán)益,發(fā)揚(yáng)中華民族傳統(tǒng)美德,構(gòu)建和諧社會具有非常重要的意義。 本文除引言外共分為五部分,對我國老年人贍養(yǎng)法律制度的缺陷及其完善做一粗淺研究： 第一部分：介紹“靳繼星訴靳開選贍養(yǎng)糾紛案”與“周玉貞訴苑永林贍養(yǎng)糾紛案”的案情,并從兩起案件出發(fā)提出本文所要研究的問題。 第二部分：指出我國老年人贍養(yǎng)法律制度的主要內(nèi)容及存在的缺陷。首先介紹我國現(xiàn)行贍養(yǎng)法律制度的主要內(nèi)容,包括《憲法》、《婚姻法》、《刑法》、《老年人權(quán)益保護(hù)法》的規(guī)定。其次指出我國現(xiàn)有的贍養(yǎng)法律制度存在的五點(diǎn)缺陷,即贍養(yǎng)義務(wù)主體范圍不完整；物質(zhì)贍養(yǎng)標(biāo)準(zhǔn)不明確；精神贍養(yǎng)規(guī)定存在疏漏；贍養(yǎng)義務(wù)人的法律責(zé)任規(guī)定不明確；“家庭養(yǎng)老”模式受到挑戰(zhàn)。 第三部分：介紹中外老年人贍養(yǎng)法律制度的規(guī)定。分別對我國古代老年人贍養(yǎng)法律制度的規(guī)定和國外老年人贍養(yǎng)法律制度的規(guī)定予以介紹,試圖從中找出完善我國贍養(yǎng)法律制度可借鑒之處。 第四部分：我國老年人贍養(yǎng)法律制度的完善。首先對完善我國老年人贍養(yǎng)法律制度的必要性進(jìn)行分析。其次從擴(kuò)大贍養(yǎng)義務(wù)主體范圍、明確物質(zhì)贍養(yǎng)標(biāo)準(zhǔn)、完善精神贍養(yǎng)的規(guī)定、明確贍養(yǎng)義務(wù)人的獎懲規(guī)則、以“家庭養(yǎng)老”為基礎(chǔ)加強(qiáng)政府和社會的責(zé)任五方面提出筆者對完善我國老年人贍養(yǎng)法律制度的具體構(gòu)想。 第五部分：結(jié)語部分是對全文的概括總結(jié),進(jìn)一步強(qiáng)調(diào)贍養(yǎng)老人的重要性,指出贍養(yǎng)老人的研究領(lǐng)域非常廣泛,本文僅從法律視角出發(fā),希望能夠運(yùn)用法律的手段更好的維護(hù)老年人的合法權(quán)益。并借此機(jī)會呼吁,每個公民都應(yīng)承擔(dān)贍養(yǎng)老人的義務(wù)。
[Abstract]:To support the elderly is a traditional virtue of the Chinese nation and a legal obligation for the maintenance obligors. With the development of the economy and society, the living standards of the people are constantly improving, but many of them regard the support of the elderly as an additional burden. Not only does it not provide for the basic needs of the elderly, or even abuse and abandon the elderly. As our country enters an aging society, there are endless maintenance disputes in our country. However, the provisions of the current laws of our country on the issue of maintenance are rather vague and general. The lack of maneuverability leads to the lack of proper protection of the legal rights and interests of the elderly. The author thinks that the study of the legal system for the maintenance of the elderly can protect the legitimate rights and interests of the elderly and promote the traditional virtues of the Chinese nation. Building a harmonious society is of great significance. In addition to the introduction, this paper is divided into five parts, the legal system of the elderly maintenance of China's defects and their improvement do a superficial study:. The first part introduces the cases of Jin Jixing v. Jin Kaixuan and Zhou Yuzhen v. Yuan Yonglin, and puts forward the problems to be studied in this paper. The second part points out the main contents and defects of the legal system of maintenance for the elderly in China. Firstly, it introduces the main contents of the current legal system of maintenance of the elderly in China. It includes the provisions of the Constitution, the Marriage Law, the Criminal Law and the Law on the Protection of the Rights and interests of the elderly. There are omissions in the provisions of spiritual support, unclear provisions on the legal liability of maintenance obligors, and challenges to the model of "family support for the aged". The third part introduces the provisions of the Chinese and foreign legal system of the maintenance of the elderly. It introduces the provisions of the ancient legal system of the maintenance of the elderly in China and the provisions of the legal system of the maintenance of the elderly in foreign countries. Try to find out the legal system of maintenance in China can be used for reference. Part 4th: the perfection of the legal system of the maintenance of the elderly in China. Firstly, the necessity of perfecting the legal system of the maintenance of the elderly in China is analyzed. Secondly, the standard of material support is defined from the expansion of the scope of the main body of the obligation of maintenance. Perfecting the stipulation of spiritual support, clarifying the rules of reward and punishment of the maintenance obligor, strengthening the responsibility of the government and the society on the basis of "family old-age support", the author puts forward the concrete idea of perfecting the legal system of the elderly maintenance in our country. Part 5th: the conclusion is a summary of the full text, further emphasizing the importance of supporting the elderly, pointing out that the research field of supporting the elderly is very wide, this article only from the legal perspective, It is hoped that the legal means can be used to better safeguard the legal rights and interests of the elderly, and take this opportunity to appeal that every citizen should bear the duty of supporting the elderly.
