【摘要】：由于家務(wù)勞動(dòng)的直接獲益者是勞動(dòng)者本人及其家屬，因此長(zhǎng)期以來家務(wù)勞動(dòng)都被視為一種家庭內(nèi)部事務(wù)，它的經(jīng)濟(jì)價(jià)值也一直為人們所忽略。我國(guó)2001年《婚姻法》第四十條首次承認(rèn)了家務(wù)勞動(dòng)補(bǔ)償請(qǐng)求權(quán)，這對(duì)于維護(hù)家庭中從事家務(wù)勞動(dòng)一方，尤其是女性一方的權(quán)益有著十分積極的意義。但《婚姻法》對(duì)家務(wù)勞動(dòng)補(bǔ)償制度的規(guī)范尚有不足，制度構(gòu)建過于籠統(tǒng)，司法操作性不強(qiáng)。文章以家務(wù)勞動(dòng)補(bǔ)償請(qǐng)求權(quán)為主要研究對(duì)象，將文獻(xiàn)研究和問卷調(diào)查的方式相結(jié)合，對(duì)文章的主要問題進(jìn)行了分析和梳理，以期提出完善相關(guān)立法的建議。 文章第一章簡(jiǎn)單介紹了家務(wù)勞動(dòng)相關(guān)原理以及我國(guó)家務(wù)勞動(dòng)補(bǔ)償制度的主要內(nèi)容；第二章對(duì)國(guó)外相關(guān)法律制度進(jìn)行了簡(jiǎn)單介紹與分析，以期對(duì)我國(guó)在同一問題的研究上有所借鑒；第三章對(duì)我國(guó)家務(wù)勞動(dòng)補(bǔ)償權(quán)的保護(hù)現(xiàn)狀進(jìn)行了分析，從家務(wù)勞動(dòng)補(bǔ)償標(biāo)準(zhǔn)和價(jià)值量化等角度入手，研究了家務(wù)勞動(dòng)補(bǔ)償實(shí)際操作中存在的困難，并在此基礎(chǔ)上進(jìn)行了理論分析，，從而進(jìn)一步提出了我國(guó)在該問題上的制度缺陷；第四章結(jié)合文章前面的內(nèi)容，對(duì)我國(guó)家務(wù)勞動(dòng)補(bǔ)償制度提出了一些具體的完善建議。
[Abstract]:Since the direct beneficiaries of domestic work are the workers themselves and their families, domestic work has long been regarded as an internal affair of the family. Article 40th of China's 2001 Marriage Law recognizes for the first time the right to claim compensation for domestic work, which is useful for the maintenance of the domestic worker in the family. In particular, the rights and interests of women have a very positive significance. However, the Marriage Law has not regulated the compensation system for domestic work, and the construction of the system is too general. The judicial maneuverability is not strong. The article regards the claim right of domestic work compensation as the main research object, combines the literature research with the questionnaire survey, analyzes and combs the main problems of the article, in order to put forward the suggestion to perfect the relevant legislation. The first chapter briefly introduces the related principles of domestic work and the main contents of China's domestic labor compensation system, the second chapter gives a brief introduction and analysis of the relevant foreign legal system. The third chapter analyzes the current situation of the protection of the right to compensation for domestic work in China, starting with the standards of compensation for domestic work and the quantitative value of domestic work, and so on. This paper studies the difficulties existing in the practical operation of domestic labor compensation, and on this basis carries on the theoretical analysis, thus further proposes the system defect on this question in our country. This paper puts forward some concrete suggestions on the compensation system of domestic work in our country.
