【摘要】：在中國傳統(tǒng)婚嫁文化中,彩禮一直都扮演著重要的角色,時至今日,給付彩禮這一習(xí)俗仍具有顯示出很強(qiáng)大的生命力而非隨著社會經(jīng)濟(jì)的發(fā)展,人們思想觀念的逐漸活躍而走向消亡,給付彩禮在民間仍廣為盛行,并以不同的方式影響著人們的生活。但由于人際關(guān)系和經(jīng)濟(jì)生活不斷復(fù)雜化,由彩禮而產(chǎn)生的糾紛就愈發(fā)增多,特別是在一些經(jīng)濟(jì)不發(fā)達(dá)的農(nóng)村地區(qū)尤為典型,甚至有雙方就彩禮返還不能達(dá)成一致意見進(jìn)而導(dǎo)致惡性刑事案件發(fā)生的情況出現(xiàn)。最高人民法院出臺的《關(guān)于適用中華人民共和國婚姻法若干問題的解釋(二)》中設(shè)置了彩禮返還規(guī)則,使彩禮問題在法律上有了明確的規(guī)定,法官也可參照適用相關(guān)規(guī)則對彩禮糾紛進(jìn)行處理。但在學(xué)界對于彩禮的性質(zhì)也存在著諸多爭議,而且彩禮返還在司法適用上也亦存在諸多疑難,這也導(dǎo)致該司法解釋在可操作性上大打折扣。本文通過對給彩禮的沿革的分析以及關(guān)于彩禮的性質(zhì)的五種學(xué)說的分析研究,認(rèn)為彩禮本身是附解除條件的贈與,而給付彩禮行為是一個傳統(tǒng)習(xí)俗,只是單純的按照法律規(guī)定機(jī)械的處理彩禮糾紛可能會不符合當(dāng)?shù)亓?xí)俗,進(jìn)而可能影響后續(xù)的判決履行,因而在處理彩禮糾紛時不僅要考慮法律規(guī)定,更要考慮當(dāng)?shù)亓?xí)俗,才能使判決發(fā)揮其定紛止?fàn)幍淖饔?本文本著以彩禮返還應(yīng)主要考慮當(dāng)?shù)亓?xí)俗為出發(fā)點(diǎn),對彩禮返還規(guī)則在糾紛主體的確定,彩禮范圍的確定以及返還數(shù)額的確定以及彩禮返還中還需酌情考慮的一些具體因素上,提出自己的解決建議。
[Abstract]:In Chinese traditional marriage culture, betrothal gifts have been playing an important role, today, this custom shows the betrothal gifts still has very strong vitality and with the development of social economy, gradually active ideas of the people and come to an end, the betrothal gifts in folk is still popular, and in a different way affects people's life. But because of the interpersonal relationship and economic life has become more complicated, and the disputes on betrothal gifts produced by more and more, especially typical in some economically underdeveloped rural areas, even the gift return cannot reach an agreement which leads to vicious criminal cases happened. The introduction of the Supreme People's the court "several issues concerning the application of People's Republic of China marriage law interpretation (two) > set the rules of the return of betrothal gifts, have a clear rule in the law so that the betrothal gifts Also, the judge can refer to the relevant rules of the dowry dispute processing. But there are many disputes in the academia for the bride's nature, and the return of betrothal gifts in the judicial application also exists many problems, which led to the judicial interpretation in operability greatly. This paper through the analysis to the evolution of the bride the research and analysis of five kinds of theories about the nature of betrothal gifts, that is the gift of conditional bride itself, and the betrothal gifts is a traditional custom, only mechanical processing in accordance with the law can not dowry dispute in accordance with local customs, which may affect the subsequent decision to perform, so in the process betrothal gifts disputes should not only consider the provisions of the law, but also to consider the local custom, in order to make the decision to play the mediating role in this text to the return of bride price should be the main consideration of local customs As a starting point, to determine the main dispute in rules of the return of betrothal gifts, betrothal gifts to determine the scope and return of some specific factors considered are needed to determine the amount and the return of bride price in, put forward their own solutions.
