【摘要】：唐代關(guān)于結(jié)婚禁止條件的立法較為嚴(yán)密,從全面確認(rèn)和維護(hù)封建倫理綱常到懲治亡匿罪犯均有所涉及。其主要內(nèi)容有:同宗共姓不得為婚;嚴(yán)禁尊卑親屬為婚和不得娶親屬妻妾;不得娶已聘定婦女;嚴(yán)禁冒婚;有妻不得更娶妻;嚴(yán)禁違時嫁娶;嚴(yán)禁奸婚;良賤不得為婚;嚴(yán)禁強(qiáng)制寡婦欲守志者改嫁;不得娶犯罪逃亡婦女為妻。其基本指導(dǎo)思想是以禮為準(zhǔn),但同時又根據(jù)社會現(xiàn)實(shí)的需要進(jìn)行了適當(dāng)調(diào)整。
[Abstract]:The legislation on the prohibition of marriage in the Tang Dynasty was relatively strict, from the comprehensive confirmation and maintenance of feudal ethical principles to the punishment of the criminal who were found dead and hiding. The main contents of the legislation were as follows: the common surname of the same clan should not be married; It is strictly prohibited for a relative to be inferior to him or for his wife or concubine; not to marry a woman who has been hired; to take no chances of marriage; not to take a wife more than once; to strictly prohibit marriage at times of violation; to prohibit marriage by adultery; to prohibit marriage at a good price; and to force widows to remarry those who wish to keep their will; It is not allowed to marry a criminal fugitive woman as a wife. Its basic guiding ideology is to take ceremony as the standard, but at the same time, it has made appropriate adjustments according to the needs of the social reality.
