【摘要】：2011年8月,《最高人民法院關(guān)于適用中華人民共和國婚姻法若干問題的解釋(三)》(下文中稱《婚姻法司法解釋(三)》)正式實(shí)施。其中關(guān)于夫妻財(cái)產(chǎn)內(nèi)容的條款引發(fā)廣泛討論,而《婚姻法司法解釋(三)》的第5條更是爭(zhēng)議焦點(diǎn)之一。《婚姻法司法解釋(三)》第5條雖然首次對(duì)婚前財(cái)產(chǎn)的婚后孳息歸屬問題作出了明確規(guī)定,但是卻并未對(duì)孳息的內(nèi)涵進(jìn)行說明,并且毫無差別地將婚前財(cái)產(chǎn)的婚后孳息排除在夫妻共同財(cái)產(chǎn)的范圍之外,這無論是在理論界還是實(shí)務(wù)界都引起了不小的爭(zhēng)議。本文首先對(duì)學(xué)術(shù)界有關(guān)孳息的概念定義進(jìn)行梳理,并在此基礎(chǔ)上對(duì)孳息的概念作相應(yīng)界定;其次,對(duì)各國有關(guān)孳息的立法例進(jìn)行分析整理,總結(jié)出我國現(xiàn)行法律關(guān)于孳息問題方面的規(guī)定所存在的不夠完善之處;最后,緊緊聯(lián)系當(dāng)前社會(huì)背景,對(duì)我國的未來立法構(gòu)想提出合理建議。在對(duì)孳息的歸屬進(jìn)行判定之時(shí),應(yīng)當(dāng)堅(jiān)持“夫妻協(xié)力”和“公平”原則,考慮夫妻是否作出了共同貢獻(xiàn)。具體來說,即在判定孳息的歸屬時(shí),具體問題具體分析,根據(jù)孳息的產(chǎn)生過程中是否包含另一方的貢獻(xiàn)進(jìn)行判定,以追求夫妻雙方利益的平衡。
[Abstract]:In August 2011, the interpretation of the Supreme people's Court concerning the application of the Marriage Law of the people's Republic of China (3) > (hereinafter referred to as the Judicial interpretation of the Marriage Law (3) >) was formally implemented. Article 5 of the Judicial interpretation of the Marriage Law (3) is one of the focuses of controversy. Article 5 of the < Judicial interpretation of the Marriage Law (3) > provides for the first time a clear stipulation on the issue of the attribution of fruits after marriage to the property before marriage. However, the connotation of fruits is not explained, and the marital fruits of premarital property are excluded from the scope of the joint property of husband and wife without distinction. This paper firstly combs the definition of fruits in academic circles, and then defines the concept of fruits accordingly. Through analyzing and sorting out the legislation examples of various countries on fruits, we conclude that the existing provisions of our country's current law on fruits are not perfect enough. Finally, we should closely relate to the current social background. In determining the ownership of fruits, we should adhere to the principles of "husband and wife cooperation" and "equity" and consider whether the husband and wife have made a common contribution. That is to say, when determining the ownership of fruits, the specific problems are analyzed concretely, according to whether or not the contribution of the other party is included in the process of producing fruits, in order to pursue the balance of the interests of husband and wife.
