【摘要】：近些年來,關(guān)于明星代孕的新聞越來越多,代孕生育漸漸走近了人們的視野。在我國,代孕生育契約是否合法的爭論尚未停止,因代孕所生育的子女親子關(guān)系糾紛又層出不窮。前者的爭論,筆者不敢在此多作判斷,因?yàn)槟切枰嗟膫惱怼⑸鐣䦟W(xué)知識,筆者試圖將代孕生育方式現(xiàn)階段下最緊迫的問題——親子關(guān)系認(rèn)定,做一個(gè)學(xué)說、立法、判例的梳理,結(jié)合我國目前的立法現(xiàn)狀和司法實(shí)踐,分別認(rèn)定母親身份與父親身份,完善我國代孕生育下親子關(guān)系認(rèn)定的規(guī)則。 本文正文部分共分為三章： 第一章為介紹國內(nèi)外學(xué)說、典型國家的立法以及經(jīng)典案例。由于我國對此立法幾乎空白,所提供的文獻(xiàn)甚少,而國外立法和判例都有一定的經(jīng)驗(yàn)，故本文主要選取國外的立法和判例。從理論到立法再到司法,試著剖析出一些共同點(diǎn)和規(guī)律。 第二章全面分析了法律應(yīng)該如何認(rèn)定代孕生育的親子關(guān)系。首先分析了現(xiàn)行我國婚姻法下的親子關(guān)系認(rèn)定規(guī)則適用于代孕生育的不妥,再試著打破原有的理念,以構(gòu)建新的父母觀的為視角找尋出新的代孕生育下親子關(guān)系認(rèn)定規(guī)則。 第三章主要是具體制度下我國代孕生育下親子關(guān)系認(rèn)定的構(gòu)建,結(jié)合前面典型立法的優(yōu)缺點(diǎn),選擇我國代孕生育下親子認(rèn)定的程序,構(gòu)建了代孕生育下親子認(rèn)定的具體規(guī)則。
[Abstract]:In recent years, more and more news about star surrogacy, surrogacy gradually approached the people's vision. In China, the legal contract of surrogacy has not stopped. Disputes about parent-child relationship between children born by surrogate pregnancy are endless. The former argument, the author dare not make more judgments here, because it needs more knowledge of ethics and sociology. The author tries to identify the most urgent problem of surrogacy at this stage-parent-child relationship, to do a theory, legislation, jurisprudence, combined with the current legislative situation and judicial practice in China. Confirm mother status and father identity, perfect the rules of parent-child relationship confirmation under surrogate pregnancy in China. The text of this paper is divided into three chapters: The first chapter is to introduce the domestic and foreign theories, the legislation of typical countries and the classic cases. Because of the blank legislation in our country, the literature provided is very few, and the foreign legislation and case law have some experience. So this article mainly selects the foreign legislation and case law. From theory to legislation to judicature, try to analyze some common points and laws. The second chapter comprehensively analyzes how the law should identify the parent-child relationship of surrogate pregnancy. Firstly, it analyzes that the rules of parent-child relationship identification under the current marriage law of our country are applicable to surrogate pregnancy. Then try to break the old idea and find out the new rules of parent-child relationship under surrogacy from the perspective of constructing a new view of parents. The third chapter is the construction of parent-child relationship identification under the specific system of surrogacy in China, combining with the advantages and disadvantages of the previous typical legislation, choose the procedure of parent-child identification under surrogate birth in China. The specific rules of paternity identification under surrogacy are constructed.
