【摘要】：人類不斷的自我繁衍,使人類社會得以延續(xù),擁有后代是每個人的權(quán)利,也是社會發(fā)展的需要,但隨著生存環(huán)境的不斷惡化,生存壓力的加大,婚姻年齡的普遍推遲等因素的作用下,使一部分人不能實現(xiàn)生兒育女的愿望。但隨著人工生殖技術(shù)的出現(xiàn)使許多不孕不育的患者實現(xiàn)了為人父母的愿望,但該技術(shù)同其他現(xiàn)代科技一樣,是把“雙刃劍”,給人類帶來福音的同時,也對親子身份如何認定的問題帶來了巨大的沖擊。 本文以生育權(quán)的倫理基礎(chǔ)為突破口,通過對生育權(quán)的分析,來證成人工生殖技術(shù)是生育權(quán)的延伸,從而在立法上找到正確的定位,最后對人工生殖子女法律地位的保護在我國的實現(xiàn)提出對策。 本文主要分為四大部分,第一部分是人工生殖技術(shù)的種類、歷史發(fā)展和倫理基礎(chǔ),這部分著重論斷人工生殖技術(shù)的倫理基礎(chǔ),從倫理基礎(chǔ)入手,說明人工生殖技術(shù)存在的必要性,推導(dǎo)出人工生殖技術(shù)不僅僅是一種生育手段,而是傳統(tǒng)理論的延伸。 第二部分介紹人工生殖技術(shù)對傳統(tǒng)親子身份認定規(guī)則的沖擊,說明人工生殖技術(shù)的出現(xiàn)以及運用,使傳統(tǒng)親子身份的認定受到了前所未有的挑戰(zhàn),尤其是對現(xiàn)有規(guī)則帶來了沖擊。即在漫長的人類歲月中,家庭是以血緣關(guān)系為紐帶建立起來的,親子關(guān)系不會混淆。但隨著人工生殖技術(shù)的廣泛應(yīng)用,人類開始面臨許多難題。人工生殖技術(shù)的適用,使血緣關(guān)系不再受特定時間、空間和輩份、年齡的限制。 第三部分主要介紹國外關(guān)于此問題的規(guī)定。 第四部分是本文的核心,通過對生育權(quán)本質(zhì)的探討,來提出人工生殖子女的法律地位認定規(guī)則在我國的構(gòu)建。
[Abstract]:The continuous self-reproduction of human beings makes the human society continue. It is the right of everyone and the need of social development to have the future generations. But with the continuous deterioration of the living environment, the pressure of survival is increasing. Due to the general delay of marriage age and other factors, some people can not realize the desire to have children. But with the emergence of artificial reproductive technology, many infertile patients have realized the desire to become parents. But this technology, like other modern technologies, is a double-edged sword, which brings good news to human beings, but also has a great impact on the identification of parent-child identity. Based on the ethical basis of reproductive rights, this paper, through the analysis of reproductive rights, proves that artificial reproductive technology is the extension of reproductive rights, thus finding the correct position in legislation. Finally, some countermeasures are put forward to protect the legal status of artificial reproductive children in China. This paper is mainly divided into four parts. The first part is the category, historical development and ethical basis of artificial reproductive technology. This part focuses on the ethical basis of artificial reproductive technology, starting from the ethical basis. The necessity of the existence of artificial reproductive technology is explained, and it is deduced that artificial reproduction technology is not only a fertility means, but also an extension of traditional theory. The second part introduces the impact of artificial reproductive technology on the traditional parent-child identity identification rules, explains the emergence and application of artificial reproductive technology, so that the identification of traditional parent-child identity has been unprecedented challenges. In particular, the impact on the existing rules, that is, in the long human years, the family is established by blood ties, parent-child relations will not be confused. But with the extensive use of artificial reproduction technology. The application of artificial reproductive technology makes blood relations no longer limited by specific time, space, generation and age. The third part mainly introduces the foreign provisions on this issue. Part 4th is the core of this paper, through the discussion of the essence of reproductive rights, this paper puts forward the establishment of legal status determination rules of artificial reproductive children in China.
