【摘要】:近年來,法學(xué)界對法律多元主義的重視和少數(shù)民族習(xí)慣法的研究日益升溫。越來越多的學(xué)者認(rèn)識到“作為中華法系重要的組成部分,少數(shù)民族習(xí)慣法是中國習(xí)慣法體系中內(nèi)容最豐富、影響最大的一種習(xí)慣法……1”,并開始不斷運(yùn)用社會(huì)學(xué)、人類學(xué)和民族學(xué)的方法、視角研究少數(shù)民族習(xí)慣法的起源、演進(jìn)和規(guī)律,積極探索習(xí)慣法與國家法之間的有益互動(dòng),尋找兩者的契合。這其中,少數(shù)民族的婚姻家庭習(xí)慣法又有著其自身獨(dú)特的意義:它不僅是民族法律制度的重要組成部分,也是反映其社會(huì)運(yùn)行狀況和倫理道德強(qiáng)化的標(biāo)志。不同民族在不同的歷史時(shí)期都有著與其自身社會(huì)體制發(fā)展相適應(yīng)的婚姻家庭法律制度,它體現(xiàn)著該民族的婚姻觀念與文化內(nèi)涵,凝聚和反映著種族承襲、演變的歷史。因此,研究少數(shù)民族的婚姻家庭習(xí)慣法,是發(fā)掘其民族文化個(gè)性和精神內(nèi)核的一種有效途徑。而事實(shí)上,只有真正實(shí)現(xiàn)了這種發(fā)掘和掌握,才有可能更好的尋找到其民族習(xí)慣法與現(xiàn)實(shí)國家法的合作路徑,從而促進(jìn)社會(huì)的和諧運(yùn)行與良性發(fā)展。 當(dāng)前針對彝族習(xí)慣法的研究主要集中在國內(nèi)學(xué)界,其中又著重以大小涼山地區(qū)作為研究的重點(diǎn)和核心。而對于地處黔西北,在歷史上同樣留下了燦爛文明的水西彝族及其習(xí)慣法,至今尚鮮有法學(xué)研究者問津。因此,大量的水西彝文原始文獻(xiàn)目前還尚未得到習(xí)慣法研究的充分利用,反倒是諸多社會(huì)學(xué)學(xué)者就語言文字、服飾、舞蹈等文化因子對水西文明進(jìn)行了深入的探微。此外,學(xué)界對于習(xí)慣法在彝族婚姻家庭方面的影響關(guān)注度較高,但整體上都分歧不大,在普遍認(rèn)識到落后的婚姻觀念,如同族內(nèi)婚、等級內(nèi)婚等違反《婚姻法》有關(guān)婚姻自由、禁止近親結(jié)婚的原則,應(yīng)當(dāng)堅(jiān)決取締的同時(shí),也普遍注意到了彝族傳統(tǒng)婚姻習(xí)慣法中積極的方面,如家支外婚、姨表不婚等。同時(shí),一些業(yè)已成為民族婚姻法學(xué)界關(guān)注焦點(diǎn),但現(xiàn)階段還未針對彝族習(xí)慣法進(jìn)行研究的話題,如登記婚與儀式婚問題、農(nóng)村婦女離婚后土地承包權(quán)問題、如何對少數(shù)民族傳統(tǒng)婚姻習(xí)慣進(jìn)行合理的現(xiàn)代化改革等,也開始逐漸成為研究的熱點(diǎn)。 在寫作方法上,本文著重通過對彝文原始文獻(xiàn)的把握以及針對現(xiàn)實(shí)狀況而進(jìn)行的田野調(diào)查,結(jié)合相關(guān)的法學(xué)、人類學(xué)和文化學(xué)知識,抽象出水西彝族婚姻家庭習(xí)慣法的基本原則,概括出水西彝族婚姻家庭習(xí)慣法的主要內(nèi)容,并對其現(xiàn)代化轉(zhuǎn)型的事實(shí)作出解讀和分析。同時(shí),本文將適當(dāng)?shù)倪\(yùn)用法人類學(xué)的“案例分析方法”,并試圖從習(xí)慣法變遷發(fā)展的視角,引發(fā)并深化對于法的演進(jìn)、法的運(yùn)行、習(xí)慣法與國家法的有益互動(dòng)等命題的認(rèn)識和思考。具體而言,本文在體例上主要由引言、正文和結(jié)語三部分組成。引言主要對水西彝族及其文化、習(xí)慣法的發(fā)展脈絡(luò)作簡要介紹。正文第一部分,主要對水西彝族和水西文化的基本情況進(jìn)行概述,包括族源歷史、地理環(huán)境和社會(huì)概況等,并在水西文化章目下專辟一節(jié)來對水西彝族習(xí)慣法做簡要介紹。第二部分著重通過對彝文文獻(xiàn)及相關(guān)資料的分析,抽象出水西彝族婚姻家庭習(xí)慣法的基本原則,并透過適當(dāng)?shù)陌咐M(jìn)行解讀。第三部分則主要運(yùn)用“動(dòng)態(tài)過程分析”的方法,以婚姻家庭生活的起始為線索,通過戀愛、結(jié)婚、生育、離婚等過程的動(dòng)態(tài)分析,還原出水西彝族婚姻家庭習(xí)慣法的主要內(nèi)容。第四部分及結(jié)語主要針對水西彝族婚姻家庭習(xí)慣法現(xiàn)代化轉(zhuǎn)型的事實(shí),通過對其原因和現(xiàn)實(shí)表現(xiàn)的分析,深化對其轉(zhuǎn)型的意義、啟示的思考,從而探求水西彝族習(xí)慣法與國家法進(jìn)一步實(shí)現(xiàn)價(jià)值契合的路徑。
[Abstract]:In recent years, the research of jurisprudence of the importance of legal pluralism and the customary law of ethnic minority rising. More and more scholars recognize "as an important part of Chinese law system, customary law of ethnic minority is Chinese custom content method in the system of the most abundant, a common law.1 the largest, and began to use social study method of Anthropology and ethnology, the origin of study from the perspective of the customary law of ethnic minority, and the evolution of law, and actively explore the beneficial interaction between the customary law and national law, looking for a fit between the two. It also has its own unique meaning of marriage customary law of the minorities: it is not only an important part of the law the system of the nation, but also reflect their social signs of strengthening health and ethics. Different nationalities in different historical periods are adapt to the development of its own social system The legal system of marriage and family, it embodies the concept of marriage and the cultural connotation of the nation's cohesion and reflects the racial inheritance history. Therefore, the customary law of marriage and family studies of ethnic minorities, is an effective way to explore the ethnic culture and spirit. In fact, only realize and master this discovery, will it be possible to better find the path of cooperation of ethnic customary law and national law reality, so as to promote the harmonious operation and the healthy development of society.
The current research on Yi customary law is mainly concentrated in the domestic academic circles, especially in the Liangshan region as the focus of the study and the core. And for the Northwest Guizhou is located in history, also left Yi customary law and splendid civilization, still fresh legal researchers interested. Therefore, making full use of a large number of the Shuixi Yi original document is still not used to study law, but many scholars of sociology on language, costumes, dance and other cultural factors for an in-depth exploration of the west civilization. In addition, for the academic habits influence Yi in the aspects of marriage and family high degree of concern, but on the whole have little differences in general, recognizing the backward concept of marriage, like endogamy, grade within marriage, marriage law > < the violation of freedom of marriage, intermarriage principle, should be resolutely banned, also generally Pay attention to the positive aspects of the traditional customary law of marriage, family support outside marriage, maternal does not marriage. At the same time, some have become the focus of national marriage law focus, but at this stage is not focused on the study of the customary law of the topic, such as registration of marriage and the marriage ceremony, the land contract right of rural women in divorce later, to the traditional marriage customs of ethnic minorities are reasonable reform and modernization, also began to gradually become a hot research topic.
In the writing method of field investigation, this article focuses on the Yi's grasp of the original documents and based on the practical situation of the related knowledge of law, anthropology and cultural studies, abstracts the basic principle of Yi customary law of marriage and family, sums up the main content of water west of the Yi customary law of marriage and family, and analysis and interpretation on the modernization of the fact. At the same time, this paper applies the appropriate legal anthropology "case analysis", and attempts to develop from the perspective of change of customary law, and lead to deepen the law of evolution, the operation of law, understanding and thinking of useful interactive propositions such as customary law and national law. Specifically, in this paper, the style is mainly composed of preface, text and conclusion of three parts. The introduction mainly to Yi culture and the development of customary law, for a brief introduction. The first part is mainly on Summarizes the basic situation of Yi and west culture, including the origin of history, geographical environment and social situation, and in water culture under Chapter dedicates a section to do a brief introduction to Yi customary law. The second part focuses on the analysis of the language of literature and related data, abstracts the basic principles of Yi the customary law of marriage and family, and through the appropriate interpretation of the case. The third part mainly uses the method of "dynamic process analysis" to start, marriage and family life as a clue, through love, marriage, family, divorce and other dynamic analysis process, restore the main content of Yi customary law of marriage and family in fourth. The main part and the conclusion in view of the fact that Yi customary law of marriage and family in the modern transformation, through the analysis of its causes and manifestation, deepen the transformation of the meaning of Enlightenment thinking, and To explore the Yi customary law and national law to further realize the path value fit.
