隨著“全球化”進(jìn)程的不斷推進(jìn),世界各國(guó)經(jīng)濟(jì)、文化日益交匯融合,各國(guó)間通過制定相關(guān)法律、締結(jié)條約,保證相互間的公平競(jìng)爭(zhēng),化解爭(zhēng)端。法律翻譯由此在全球范圍內(nèi)成為用以消解不同法系、不同語言、不同文化間的障礙的有效工具。 然而,和國(guó)際社會(huì)每日大量的法律文本的翻譯實(shí)踐相比,對(duì)法律翻譯的研究卻相對(duì)落后。國(guó)內(nèi)外傳統(tǒng)上對(duì)法律翻譯的研究認(rèn)為:法律翻譯就是語言轉(zhuǎn)換,主要從單一的詞句等層面展開,單純追求譯文對(duì)原文的忠實(shí),卻忽略了法律語言的特殊性。而實(shí)際上,法律翻譯的復(fù)雜性并不僅限于此,其與翻譯者、翻譯策略、翻譯對(duì)象及功能之間的影響相輔相成。在過去的幾十年里,法律翻譯的研究逐步深入;隨著翻譯目的及對(duì)象在翻譯過程中作用的明確,由德國(guó)功能翻譯理論學(xué)派代表漢斯?威密爾提出的目的論引起越來越多的關(guān)注。目的論強(qiáng)調(diào)翻譯目的在翻譯過程中的決定性作用,適用于諸如法律文本翻譯,此類帶有特殊功能及目的的翻譯行為。 本文的研究是以功能翻譯理論為框架,嘗試將功能目的論應(yīng)用于法律文本的分析和法律翻譯的實(shí)踐中。由于法律翻譯相應(yīng)地會(huì)因?yàn)椴煌慕浑H目的而承載著不同的功用,相較于其他傳統(tǒng)翻譯理論,以目的論為代表的功能翻譯理論無疑更適用于法律文...
