　　交際翻譯試圖使其讀者產(chǎn)生的效果盡量接近于源語讀者所獲得的效果。語義翻譯要在譯語句法結構和語義結構允許的前提下,在譯文中產(chǎn)生相似或完全一樣的語境意義。根據(jù)對文本功能的分類,紐馬克認為法律文本屬于表達型文本,因此法律翻譯應采取語義翻譯。 作者認為紐馬克的這一陳述主要適用于源語和目標語的語言體系和結構相似的情況。如果源語和目標語屬于不同的語系,在思維方式和語言結構等方面就會有差異。比如說,英語和漢語屬于不同的語系,由于英漢兩種語言在思維方式,表達習慣,以及法律文化等方面的差異,單純地進行語義翻譯是行不通的。本文作者認為在法律翻譯中語義翻譯和交際翻譯是互相補充的。在法律翻譯的初始階段譯者應遵循語義翻譯,盡可能在詞匯,句子等方面與原文一致。而在第二階段采用交際翻譯,譯者要充分考慮目標語和源語之間的種種差異,積極發(fā)揮譯者的創(chuàng)造性,以讀者的角度審視并詮釋原文,用目標語對原文的內涵進行再創(chuàng)造,達到譯文與原文在法律效力上的對等。作者認為可以將語義翻譯和交際翻譯有效地結合,從而更好地增強法律譯本的可讀性。本文從這一主題入手,試運用紐馬克的這兩個著名翻譯理論對中華人民共和國合同法的兩個英譯本進行評析。
