無固定期限勞動合同相關(guān)問題探析

【摘要】:《勞動合同法》的頒布,在制度設(shè)計(jì)上,平衡合同雙方當(dāng)事人的權(quán)益,但更多的人都認(rèn)為本法更多的保護(hù)了勞動者的權(quán)益,對用人單位的限制性條款較多。不可否認(rèn),公權(quán)力干預(yù)勞資關(guān)系,有利于勞動者的弱勢地位的提高,但大家對本法的認(rèn)識還存在一定的誤區(qū),特別是無固定期限勞動合同制度,本文從該制度的立法意義出發(fā),對現(xiàn)實(shí)生活中經(jīng)常面臨的幾個問題談?wù)勛约旱目捶ā?br/>[Abstract]:The promulgation of Labor contract Law, in terms of system design, balances the rights and interests of both parties to the contract, but more people think that this law protects the rights and interests of labourers more, and there are more restrictive clauses on the unit of choose and employ persons. It is undeniable that the interference of public power in labor-capital relations is beneficial to the improvement of the weak position of labourers, but there are still some misunderstandings in our understanding of this law, especially the system of labor contracts with no fixed term. This article starts from the legislative significance of this system. Talk about several problems that are often faced in real life.
