白銀市勞務(wù)派遣監(jiān)管評價體系研究

【摘要】:勞務(wù)派遣作為一種新的就業(yè)和用工形式對我國勞動領(lǐng)域產(chǎn)生了深刻的影響,在促進經(jīng)濟發(fā)展過程中發(fā)揮了重要的作用。但是,由于勞動市場供求關(guān)系失衡及監(jiān)管工作不到位,用工單位侵害勞務(wù)派遣人員合法權(quán)益的現(xiàn)象時有發(fā)生。盡管勞動監(jiān)察部門采取了多種監(jiān)管措施,但仍然存在不少問題。勞務(wù)派遣監(jiān)管工作成效到底如何,還存在哪些問題需要解決,沒有一個明確的答案。因此,構(gòu)建一套針對勞務(wù)派遣監(jiān)管工作效果評價的指標體系十分必要。 本文以甘肅省白銀市的勞務(wù)派遣監(jiān)管工作為研究對象,以文獻研究法、規(guī)范分析法和實證分析法作為主要研究方法,以《勞動合同法》、《勞動保障監(jiān)察條例》為依據(jù),結(jié)合白銀市勞務(wù)派遣監(jiān)管工作問題分析,提出了構(gòu)建勞務(wù)派遣監(jiān)管評價指標體系的研究目標,旨在通過指標體系對監(jiān)管過程和結(jié)果進行控制,達到了解監(jiān)管實際情況、發(fā)現(xiàn)問題、分析問題,從而解決問題的目的,增強監(jiān)管工作的有效性。 本文的研究重點集中在解決勞務(wù)派遣監(jiān)管效果評價的技術(shù)性問題方面,即如何建立一套考評指標體系,以及這一套指標體系的內(nèi)容是什么,包括勞務(wù)派遣監(jiān)管效果評價體系的框架結(jié)構(gòu)、指標體系構(gòu)建原則、評價指標及說明、指標評價標準及指標權(quán)重設(shè)定等內(nèi)容。最后,本文結(jié)合白銀市勞務(wù)派遣監(jiān)管工作的實際情況對評價指標體系進行驗證,并在此基礎(chǔ)上探討實施效果評價體系的保障機制,努力使之具有可操作性和有效性。同時,通過本文研究成果及存在不足的分析,能夠為其他有志于研究勞務(wù)派遣監(jiān)管問題的學(xué)者和勞動監(jiān)察從業(yè)人員提供積極的借鑒。
[Abstract]:As a new form of employment and employment, labor dispatch has had a profound impact on the labor field in China, and has played an important role in the process of promoting economic development. However, due to the imbalance between supply and demand in the labor market and the lack of supervision, the phenomenon of labor units infringing on the legitimate rights and interests of labor dispatch personnel occurs from time to time. Although labor inspection department has taken a variety of regulatory measures, but there are still many problems. There is no clear answer as to the effectiveness of labor dispatch supervision and what problems need to be solved. Therefore, it is necessary to set up an index system to evaluate the effect of labor dispatch supervision. This paper takes the supervision of labor dispatch in Baiyin City of Gansu Province as the research object, takes the literature research method, the normative analysis method and the empirical analysis method as the main research method, and takes the Labor contract Law and the Labor Security Supervision regulations as the basis. Based on the analysis of the supervision of labor dispatch in Baiyin City, this paper puts forward the research goal of constructing the evaluation index system of labor dispatch supervision, which aims to control the supervision process and result through the index system, so as to understand the actual situation of supervision. Identify problems, analyze them, solve them and enhance the effectiveness of regulatory work. The research focus of this paper is to solve the technical problems of the evaluation of the supervision effect of labor dispatch, that is, how to establish a set of evaluation index system, and what is the content of this set of index system. It includes the frame structure of the evaluation system of supervision effect of labor dispatch, the principle of constructing the index system, the evaluation index and its explanation, the evaluation standard and the setting of index weight, etc. Finally, this paper verifies the evaluation index system according to the actual situation of labor dispatch supervision in Baiyin city, and discusses the safeguard mechanism of implementing the effect evaluation system on this basis, and makes great efforts to make it operable and effective. At the same time, through the research results and the analysis of the shortcomings, it can provide positive reference for other scholars and labor inspectors who are interested in studying the supervision of labor dispatch.
