【摘要】：法律行為基礎(chǔ)瑕疵制度2002年被納入《德國民法典》。法律行為基礎(chǔ)瑕疵制度與我國現(xiàn)行民法中的重大誤解制度、顯失公平制度、附條件法律行為制度存在區(qū)別,并且具有獨立的價值基礎(chǔ)。因此,我國未來民法典應當引進此種制度,并對該制度實行分別立法的模式,將法律行為基礎(chǔ)欠缺制度規(guī)定于總則編,將法律行為基礎(chǔ)喪失制度規(guī)定于合同法編。
[Abstract]:The basic defect system of legal act was incorporated into the German Civil Code in 2002. There are differences between the basic defective system of legal acts and the system of major misunderstandings in the current civil law of our country, the system of manifestly unfair and the system of conditional legal acts, and it has an independent value basis. Therefore, the future civil code of our country should introduce this kind of system, and carry out the model of legislating separately to this system, the system of lacking the legal behavior foundation in the general rule, and the system of losing the legal act foundation in the contract law.
