【摘要】：在過(guò)去的十年中,我國(guó)電子商務(wù)快速發(fā)展。但是,無(wú)可避免的一個(gè)問(wèn)題是電子商務(wù)交易糾紛開始逐漸增多。一方面,以《合同法》為代表的法律規(guī)則對(duì)于此類糾紛的解決缺乏效率;另一方面,又缺乏有效的糾紛解決機(jī)制。在如此背景下,"淘寶"自治規(guī)則等非法律規(guī)則油然而生。本文將對(duì)此類自治規(guī)則與《合同法》等法律規(guī)則進(jìn)行比較分析,并希冀為電子商務(wù)秩序之規(guī)范提供一種新的路徑。
[Abstract]:In the past ten years, our country electronic commerce develops rapidly. However, an unavoidable problem is that electronic commerce transaction disputes begin to increase gradually. On the one hand, the legal rules represented by contract Law are inefficient in resolving such disputes; on the other hand, there is a lack of effective dispute resolution mechanism. In this context, "Taobao" autonomy rules and other non-legal rules arise spontaneously. This paper makes a comparative analysis of this kind of autonomy rules and other legal rules such as contract Law and hopes to provide a new way for the regulation of electronic commerce order.
