【摘要】：正 【裁判要旨】律師事務(wù)所指派律師代理委托人進行訴訟活動,因其在訴訟中代理委托人提出的訴訟請求僅獲得了法院的部分支持,委托人要求律師事務(wù)所賠償未獲支持部分所多繳納的訴訟費。在這種情況下,律師事務(wù)所是否應(yīng)當承擔賠償責任,應(yīng)當根據(jù)其與委托人訂立的委托合同中約定的義務(wù)以及合同法、律師法等相關(guān)法律所規(guī)定的法定義務(wù)為依據(jù),來界定律師的執(zhí)業(yè)行為是否存在過錯并實際導(dǎo)致了損失的發(fā)生。
[Abstract]:The law firm appoints the lawyer to represent the client in the litigation, because the litigation request made by the client in the lawsuit is only partially supported by the court. The client claims the law firm for the extra costs it paid for the unsupported portion. In this case, whether the law firm should bear the liability for compensation should be based on the obligations stipulated in the entrustment contract concluded between the firm and the client, as well as the legal obligations stipulated in the relevant laws such as the contract law, the lawyer's law, etc. To determine whether the lawyer's practice of fault and actually lead to the occurrence of losses.
