【摘要】：贈(zèng)與人的窮困抗辯權(quán)是合同法對(duì)贈(zèng)與人權(quán)益的一種保護(hù)。本文著重討論窮困抗辯權(quán)的理論基礎(chǔ)、性質(zhì)、適用條件和法律后果,以期在實(shí)踐中更好地運(yùn)用這一制度。
[Abstract]:Donator's right of poor defense is a kind of protection of donator's rights and interests in contract law. This paper focuses on the theoretical basis, nature, applicable conditions and legal consequences of the right to defend poverty in order to make better use of the system in practice.
