【摘要】：近年來,隨著經濟的快速發(fā)展,人們的婚姻家庭觀念發(fā)生了較大的變化。越來越多的夫妻,為了維護婚姻關系的穩(wěn)定和自身的權益,簽署了夫妻忠誠協(xié)議。當前法律以立法的形式將“夫妻應當相互忠實”寫入了法條,但對夫妻忠誠協(xié)議卻沒有明確的規(guī)定。關于夫妻忠誠協(xié)議的效力,無論是法學界還是司法實踐中都存在較大的爭議,導致各地法院在審理案件時,出現了同案卻不同判的情形。因此,文章將通過對夫妻忠誠協(xié)議的全面分析,針對當前法律的局限性提出建議。文章對夫妻忠誠協(xié)議的分析分為四個部分:第一部分,通過對三個經典案例的分析,引出夫妻忠誠協(xié)議的爭議焦點;第二部分,介紹了夫妻忠誠協(xié)議的含義、性質以及類型;第三部分,對夫妻忠誠協(xié)議的效力進行了法律分析;第四部分,分析了夫妻忠誠協(xié)議在立法和司法中的局限性,并將如何應對夫妻忠誠協(xié)議的缺陷,提出了司法解釋和司法審理的建議。
[Abstract]:In recent years, with the rapid development of economy, people's concept of marriage and family has changed greatly. More and more couples, in order to maintain the stability of marriage and their own rights and interests, signed loyalty agreements. The current law contains "husband and wife shall be faithful to each other" in the form of legislation, but there is no clear stipulation on the agreement of marital loyalty. About the validity of the agreement of husband and wife loyalty, whether in the legal circles or in judicial practice, there are great disputes, which leads to the different judgments in the same case when the local courts try the cases. Therefore, through the comprehensive analysis of husband and wife loyalty agreement, the article puts forward some suggestions on the limitation of current law. The article is divided into four parts: the first part, through the analysis of three classic cases, draw the dispute focus of the agreement, the second part, introduced the meaning, nature and types of the agreement. In the third part, the validity of the agreement of husband and wife loyalty is analyzed. In the fourth part, the author analyzes the limitation of husband and wife loyalty agreement in legislation and judicature, and how to deal with the limitation of husband and wife loyalty agreement, and puts forward some suggestions of judicial interpretation and judicial trial.
