【摘要】：最高人民法院《關(guān)于審理建筑物區(qū)分所有權(quán)糾紛案件具體應(yīng)用法律若干問題的解釋(征求意見稿)》中肯定了部分非所有權(quán)人的"業(yè)主"地位,擴大了業(yè)主的范圍。但此舉與現(xiàn)行通說相悖,將引發(fā)諸多的法律沖突。要明確尚未取得所有權(quán)的買受人、受贈人等實際占有使用人就區(qū)分所有建筑物的權(quán)利義務(wù),并不一定非要賦予其"業(yè)主"地位,可以通過合同法原理、專有部分占有人的新設(shè)或《物權(quán)法》占有規(guī)定的準(zhǔn)用等予以解決。
[Abstract]:The interpretation (draft of soliciting opinions) on the application of the law in the hearing of disputes over the division of ownership of buildings by the Supreme people's Court affirms the "owner" status of some non-owners and expands the scope of the owners. But this is contrary to the current general theory, will lead to many conflicts of law. In order to make it clear that buyers who have not yet acquired ownership, actual occupants, such as the grantee, are required to distinguish between the rights and obligations of all buildings, they do not necessarily have to be given the status of "owner". They can adopt the principle of contract law. The new establishment of the exclusive part possessor or the right to use the possession provisions of the property Law shall be solved.
