【摘要】:正《合同法》第二十三章對(duì)居間合同作了規(guī)定。在二手房交易中,大部分交易合同(買賣和租賃合同)是通過房地產(chǎn)經(jīng)紀(jì)機(jī)構(gòu)居間促成簽訂的,由此引發(fā)了大量追索居間報(bào)酬、必要費(fèi)用等居間合同糾紛案件。如何正確審理此類案件,亟需明確一些熱點(diǎn)、難點(diǎn)問題,筆者謹(jǐn)對(duì)此進(jìn)行探析,以拋磚引玉。一、居間人收取居間報(bào)酬的條件應(yīng)嚴(yán)格限定為"促成
