【摘要】：大宗商品中遠(yuǎn)期交易在我國作為一種新型的交易形式,面臨著法律依據(jù)不充分、交易參與方主體不明確、交易的安全性不夠等一些問題�？梢赃\(yùn)用一些司法原則,諸如已發(fā)生的交易有效原則、以合同法為適用依據(jù)原則、中遠(yuǎn)期交易市場可以為訴訟主體原則、控制風(fēng)險原則解決大宗商品中遠(yuǎn)期交易糾紛。
[Abstract]:As a new type of trading form in China, middle and forward trading of commodities faces some problems, such as insufficient legal basis, unclear parties involved in the transaction, insufficient security of transactions, and so on. Some judicial principles can be applied, such as the effective principle of transaction that has occurred, the applicable principle of contract law, the principle of subject of litigation and the principle of controlling risk in the market of medium and forward trading to solve the dispute of middle and long term trading of large commodities.
