論我國無固定期限勞動合同制度

【摘要】: 無固定期限勞動合同制度是我國勞動合同法律制度的重要組成部分,它對維護勞動者的合法權(quán)益,調(diào)動勞動者的積極性,提高用人單位的經(jīng)濟效益具有十分重要的意義;另外由于無固定期限勞動合同制度在設(shè)計上充分體現(xiàn)著公法對私法的干預(yù),因此它對穩(wěn)定勞動關(guān)系,促進社會穩(wěn)定健康發(fā)展有著十分重要的作用。本文結(jié)合《勞動合同法》頒布實施前夕,出現(xiàn)的一些用人單位對無固定期限勞動合同制度產(chǎn)生的誤解、“懼怕”而紛紛解雇勞動者的現(xiàn)象進行分析,運用比較與案例分析的方法展開論述。 本文一共分為四個部分來展開論述。 第一部分主要內(nèi)容是無固定期限勞動合同制度的概述。通過對勞動合同的概念、特征及分類進行粗淺概述,對無固定期限勞動合同制度進行定位,然后展開對無固定期限勞動合同的基本理論進行概述。 第二部分是關(guān)于無固定期限勞動合同制度在我國的立法演變。我國用工制度經(jīng)歷了固定工制度階段與勞動合同制度階段,形成中國特色的勞動合同制度。在這一部分,筆者對我國無固定期限勞動合同制度的歷史沿革進行介紹分析,再與國外關(guān)于該制度的發(fā)展狀況相比較,確定二者的異同,為后部分論述奠定基礎(chǔ)。 第三部分介紹我國無固定期限勞動合同制度的現(xiàn)狀。結(jié)合我國現(xiàn)行法律的相關(guān)規(guī)定,對合同的訂立條件、合同的變更與解除進行較為全面分析論述。 第四部分是我國無固定期限勞動合同制度存在的不足與完善。通過分析國內(nèi)遇到的實務(wù)性問題與國外關(guān)于無固定期限勞動合同制度規(guī)定的比較研究,闡述我國該制度的規(guī)定存在的不足,并對我國該制度的完善提出自己建議與意見。其中對該制度完善主要包括訂立條件的完善,無固定期限勞動合同變更與解除制度的完善。
[Abstract]:Non-fixed term labor contract system is an important part of the legal system of labor contract in our country. It is of great significance to safeguard the legitimate rights and interests of the laborer, arouse the enthusiasm of the laborer, and improve the economic benefit of the employing unit. In addition, the system of labor contract with no fixed term fully reflects the intervention of public law in private law, so it plays a very important role in stabilizing labor relations and promoting the stable and healthy development of society. On the eve of the promulgation and implementation of the Labor contract Law, this paper analyzes the phenomenon that some employers have misunderstandings about the system of labor contracts with no fixed term and are "afraid" to fire workers one after another. Use the method of comparison and case analysis to discuss. This article is divided into four parts to discuss. The first part is the summary of the system of labor contract with no fixed term. In this paper, the concept, characteristics and classification of labor contract are summarized, the system of labor contract with no fixed term is defined, and the basic theory of labor contract with no fixed term is summarized. The second part is about the legislative evolution of the non-fixed-term labor contract system in our country. The employment system of our country has experienced the stage of fixed labor system and labor contract system, forming the labor contract system with Chinese characteristics. In this part, the author introduces and analyzes the historical evolution of the system of labor contract with no fixed term in China, and then compares the development of the system with that of foreign countries, determines the similarities and differences between the two, and lays a foundation for the latter part of the discussion. The third part introduces the present situation of the system of labor contract with no fixed term in our country. Combined with the relevant provisions of the current law of our country, this paper makes a comprehensive analysis on the conditions for the conclusion of the contract, the modification and dissolution of the contract. The fourth part is the deficiency and perfection of labor contract system without fixed term in our country. By analyzing the practical problems encountered in China and the comparative study on the provisions of the system of labor contracts with no fixed term abroad, this paper expounds the shortcomings of the provisions of this system in China, and puts forward its own suggestions and opinions on the perfection of the system in our country. The perfection of the system includes the consummation of the conditions and the perfection of the system of changing and rescinding the labor contract with no fixed term.
