【摘要】：《中華人民共和國(guó)合同法》明確規(guī)定：當(dāng)事人行使權(quán)利、履行義務(wù)應(yīng)當(dāng)遵循誠(chéng)實(shí)信用原則。誠(chéng)實(shí)信用原則要求當(dāng)事人在訂立、履行、變更、終止合同的全過(guò)程以及合同解釋等方面都要誠(chéng)實(shí)，講信用，相互協(xié)助，不得濫用權(quán)利。將誠(chéng)實(shí)信用原則寫進(jìn)合同法有利于指導(dǎo)合同當(dāng)事人的活動(dòng)，體現(xiàn)了誠(chéng)實(shí)信用原則在合同法中的應(yīng)有地位。
[Abstract]:The contract Law of the people's Republic of China clearly stipulates that the parties shall abide by the principle of good faith in exercising their rights and performing their obligations. The principle of good faith requires the parties to be honest in the whole process of conclusion, performance, modification, termination and interpretation of the contract, to speak credit, to assist each other, and not to abuse their rights. Writing the principle of good faith into contract law is conducive to guiding the activities of the parties to the contract, and reflects the due status of the principle of good faith in the contract law.
