【摘要】：當(dāng)前我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)發(fā)展迅速，國(guó)際經(jīng)濟(jì)環(huán)境更是復(fù)雜多變。發(fā)生于1998年的亞洲金融危機(jī)和2008年的世界金融危機(jī)不僅對(duì)國(guó)家經(jīng)濟(jì)活動(dòng)產(chǎn)生巨大影響更是對(duì)民商事主體所定契約產(chǎn)生不可忽視的影響——圍繞社會(huì)經(jīng)濟(jì)情況的變化，合同的履行往往會(huì)產(chǎn)生各種各樣的問(wèn)題。為了促進(jìn)社會(huì)主義市場(chǎng)經(jīng)濟(jì)健康發(fā)展、維護(hù)正常的市場(chǎng)秩序、維護(hù)合同雙方的利益平衡，最高人民法院在《合同法解釋?zhuān)ǘ分写_立了情勢(shì)變更原則。 本文分六章對(duì)情勢(shì)變更原則做了初步探討與研究。第一章為探源，，介紹該原則從產(chǎn)生到成熟的過(guò)程；第二章情勢(shì)變更原則概念，通過(guò)簡(jiǎn)要闡述情勢(shì)變更原則的概念，揭示該原則包含的價(jià)值取向；第三章闡述各國(guó)立法及司法實(shí)踐對(duì)情勢(shì)變更原則規(guī)定的比較；第四章中國(guó)司法實(shí)踐，闡述情勢(shì)變更原則在我國(guó)司法實(shí)踐中的運(yùn)用；第五章原則的適用，通過(guò)分析兩個(gè)案例說(shuō)明情勢(shì)變更原則如何適用于具體案件；第六章我國(guó)情勢(shì)變更制度的完善，比較分析國(guó)外立法對(duì)情勢(shì)變更原則的規(guī)定繼而從實(shí)體以及程序上對(duì)我國(guó)目前的情勢(shì)變更制度提出完善建議。通過(guò)上述探討，以期對(duì)情勢(shì)變更有一個(gè)較全面的理解、更好地解決實(shí)務(wù)中的法律問(wèn)題。
[Abstract]:At present, China's socialist market economy is developing rapidly, and the international economic environment is more complex and changeable. The Asian financial crisis that occurred in 1998 and the world financial crisis in 2008 not only had a tremendous impact on national economic activities, but also had an unnegligible impact on the contracts entered into by civil and commercial subjects-around the changes in social and economic conditions. The performance of contracts often leads to various problems. In order to promote the healthy development of the socialist market economy, to maintain normal market order, and to maintain the balance of interests of both parties to the contract, The Supreme people's Court established the principle of situation change in interpretation of contract Law (2). The first chapter is to explore the origin of the principle, to introduce the process from its emergence to maturity, the second chapter is the concept of the principle of change of circumstances, through a brief description of the concept of the principle of change of circumstances, to reveal the value orientation contained in the principle; The third chapter expounds the comparison between the legislation of various countries and the judicial practice on the principle of change of circumstances; the fourth chapter, the judicial practice of China, expounds the application of the principle of change of circumstances in the judicial practice of our country; the fifth chapter, the application of the principle, Through the analysis of two cases to illustrate how the principle of change of circumstances applies to specific cases. Chapter VI the perfection of the system of situation change in China. This paper compares and analyzes the provisions of foreign legislation on the principle of situation change and then puts forward some suggestions on the improvement of the present situation change system of our country from the substantive and procedural aspects. Through the above discussion, we hope to have a more comprehensive understanding of the situation change and better solve the legal problems in practice.
