【摘要】：近年來,高校辦學(xué)規(guī)模不斷擴(kuò)大,后勤服務(wù)需求日益增長,高校紛紛聘用臨時(shí)工從事后勤服務(wù)工作,臨時(shí)工進(jìn)入高校后勤、安全保衛(wèi)等大部分領(lǐng)域,逐漸成為高校人事管理不可或缺的組成部分。在《勞動合同法》背景下,高校如果對《勞動合同法》及其相關(guān)司法解釋的規(guī)定不加以重視,將會大大增加用人風(fēng)險(xiǎn),一旦出現(xiàn)訴訟,將會陷入非常被動的局面。因此,如何在法律框架下科學(xué)的使用和管理臨時(shí)工,避免勞動糾紛,構(gòu)建和諧勞動關(guān)系是當(dāng)前各高校亟待解決的問題。
[Abstract]:In recent years, the scale of running a university has been expanding and the demand for logistics service has been increasing. Colleges and universities have employed temporary workers to work in logistics services, and temporary workers have entered most fields, such as university logistics, security, and so on. It has gradually become an indispensable part of personnel management in colleges and universities. Under the background of "Labor contract Law", if colleges and universities do not attach importance to the provisions of "Labor contract Law" and its related judicial interpretation, it will greatly increase the employment risk, once there is a lawsuit, it will fall into a very passive situation. Therefore, how to use and manage temporary workers scientifically under the legal framework, to avoid labor disputes and to build harmonious labor relations is an urgent problem to be solved in colleges and universities.
