從外商代表處用工看勞務(wù)派遣背后的制度沖突

【摘要】:2012至2013年間,國(guó)家相繼出臺(tái)《勞動(dòng)合同法修正案》、《關(guān)于審理勞動(dòng)爭(zhēng)議件適用法律若干問(wèn)題的解釋(四)》(以下簡(jiǎn)稱《司法解釋四》)以及《勞務(wù)派遣若干規(guī)定(征求意見(jiàn)稿)》(以下簡(jiǎn)稱《若干規(guī)定》)等多個(gè)勞動(dòng)相關(guān)立法,意在進(jìn)一步整治勞動(dòng)力市場(chǎng),尤其是勞務(wù)派遣。巧合的是,三部法案都直接或者間接涉及外商代表處用工,并在“究竟是否應(yīng)當(dāng)賦予外商代表處直接用工權(quán)?”,“外商代表處的勞務(wù)派遣是否應(yīng)當(dāng)納入三性規(guī)范中去?”等問(wèn)題的決斷上反復(fù)糾結(jié),其中映射出勞務(wù)派遣問(wèn)題之復(fù)雜、立法者的意圖與勞動(dòng)力市場(chǎng)之間的角力。 本文從“外商代表處用工”這一問(wèn)題作為切入點(diǎn),通過(guò)對(duì)于“是否賦予外商代表處直接用工權(quán)”的可行性分析,探究了最高院在立法時(shí)的思維轉(zhuǎn)變。同時(shí),從國(guó)內(nèi)、國(guó)外兩個(gè)視角,結(jié)合歷史和現(xiàn)狀兩個(gè)維度,多方位對(duì)比后反思我國(guó)現(xiàn)有勞務(wù)派遣相關(guān)規(guī)定的思維盲區(qū)。最終得出結(jié)論,我國(guó)的勞務(wù)派遣的形成原因、應(yīng)用現(xiàn)狀均與國(guó)外的勞務(wù)派遣模式存在較大差異,簡(jiǎn)單套用國(guó)外勞務(wù)派遣的“三性”理念,意在管控目前失控的勞務(wù)派遣市場(chǎng)只能適得其反。只有意識(shí)到勞務(wù)派遣背后的制度沖突,理順從計(jì)劃經(jīng)濟(jì)向市場(chǎng)經(jīng)濟(jì)轉(zhuǎn)軌的一系列關(guān)系和矛盾,放松對(duì)勞務(wù)派遣目前的行政管制,勞動(dòng)力市場(chǎng)才會(huì)自行調(diào)節(jié)消化各種不適,最終走向理性和健康。 本文除導(dǎo)言及結(jié)語(yǔ)外,共分五章,,概括如下: 第一章通過(guò)分析在《司法解釋四》正式出臺(tái)前后,最高院對(duì)于是否賦予外商代表處直接用工權(quán)問(wèn)題上的反復(fù),透過(guò)現(xiàn)象探究出了最高院從觀念邏輯回歸現(xiàn)實(shí)邏輯的思維轉(zhuǎn)變。 第二章分別通過(guò)國(guó)內(nèi)、國(guó)外兩個(gè)視角,回顧我國(guó)勞務(wù)派遣的起源,探索勞務(wù)派遣在國(guó)外的產(chǎn)生與特征。通過(guò)兩個(gè)視角的對(duì)比,反思了我國(guó)目前對(duì)于勞務(wù)派遣管理的思維盲區(qū)。 第三章聚焦目前被社會(huì)詬病最多的國(guó)有企業(yè)勞務(wù)派遣,深入研究其內(nèi)部形成原因,外部的行政管制,以及勞務(wù)派遣背后的制度沖突。 第四章通過(guò)借鑒美國(guó)、日本兩國(guó)對(duì)于勞務(wù)派遣的治理思路,提煉出值得我國(guó)學(xué)習(xí)的管理經(jīng)驗(yàn)。 第五章展望未來(lái),期望政府能夠盡早停止過(guò)度干預(yù),適當(dāng)放松管制,才是還原勞動(dòng)力市場(chǎng)正常秩序的唯一出路。
[Abstract]:Between 2012 and 2013, The State has successively promulgated the Amendment to the Labor contract Law, the interpretation of certain issues concerning the applicable Law of handling Labor disputes (4) > (hereinafter referred to as the Judicial interpretation IV) and the provisions on the dispatch of Labor Services (draft for soliciting opinions) (as follows) (referred to as "some provisions") and other labor-related legislation, Intends to further renovate the labor market, especially the labor dispatch. Coincidentally, the three bills directly or indirectly involve the employment of foreign representative offices, and "should the right of direct employment of foreign representative offices be granted?" and "should the labor dispatch of foreign representative offices be included in the three kinds of regulations?" It reflects the complexity of the issue of labor dispatch and the struggle between the legislator's intention and the labor market. Based on the analysis of the feasibility of "whether to grant the foreign representative office the right of direct employment", this paper probes into the change of thinking of the Supreme Court in the legislative process from the point of view of the issue of "employing foreign representative office" as a starting point. At the same time, from the two perspectives of domestic and foreign, combined with the two dimensions of history and present situation, this paper reflects on the thinking blind zone of the related regulations of labor dispatch in our country after multi-directional comparison. Finally, it is concluded that the reasons for the formation and application of labor dispatch in China are different from those in foreign countries, and the concept of "three properties" of labor dispatch abroad is simply applied. Attempts to control the currently out-of-control labor dispatch market are counterproductive. Only by realizing the institutional conflicts behind the dispatch of labor services, straightening out a series of relations and contradictions in the transition from a planned economy to a market economy, and relaxing the current administrative control over the dispatch of labor services, can the labor market adjust and digest all kinds of discomfort on its own, Finally, toward rationality and health. In addition to the introduction and conclusion, this paper is divided into five chapters, which are summarized as follows: The first chapter through the analysis before and after the "Judicial explanation IV" formally issued, the Supreme Court of whether to grant the foreign representative office of direct employment rights repeatedly, through the phenomenon to explore the Supreme Court from the concept of logic back to the reality of the logic of thinking. The second chapter reviews the origin of labor dispatch in China from two perspectives of domestic and foreign, and explores the origin and characteristics of labor dispatch in foreign countries. Through the comparison of two angles of view, this paper reflects on the blind zone of thinking about labor dispatch management in our country at present. The third chapter focuses on the labor dispatch of state-owned enterprises, which has been criticized most by the society at present, and deeply studies the causes of its internal formation, the external administrative control, and the institutional conflicts behind the labor dispatch. The fourth chapter abstracts the management experience of our country through drawing lessons from the management ideas of the United States and Japan for labor dispatch. The fifth chapter looks forward to the future and expects the government to stop excessive intervention as soon as possible and to relax its control properly, which is the only way to restore the normal order of the labor market.
