【摘要】：為第三人利益的合同在兩大法系國家已居于十分重要的地位。我國的合同法對為第三人利益的合同的規(guī)定存在著漏洞,應學習其他國家相關規(guī)定的長處,完善對為第三人利益的合同的規(guī)定。一方面應該在合同法內直接明確規(guī)定第三人的直接請求給付的權利,另一方面也應該對為第三人利益合同的相關制度進行完善。
[Abstract]:The contract for the benefit of the third party has occupied a very important position in the two legal system countries. The contract law of our country has the loophole to the contract for the benefit of the third party. We should study the advantages of the relevant provisions of other countries and perfect the stipulation of the contract for the benefit of the third party. On the one hand, the right of the third party's direct request for payment should be stipulated directly in the contract law, on the other hand, the relevant system of the contract for the third party's interests should be perfected.
