【摘要】：表見(jiàn)代理制度是在市場(chǎng)經(jīng)濟(jì)發(fā)展到一定程度、代理關(guān)系逐漸復(fù)雜多樣、紛爭(zhēng)頻繁的情況下 ,為了保證交易安全及保護(hù)善意第三人的合法利益的情況下建立起來(lái)的法律制度。它的建立雖幾經(jīng)爭(zhēng)議 ,但卻獲得理論界和立法界的首肯和認(rèn)可 ,因此 ,《合同法》對(duì)表見(jiàn)代理首先予以規(guī)定 ,對(duì)代理制度的完善與發(fā)展起到了重要的推動(dòng)作用。新《保險(xiǎn)法》增加了表見(jiàn)代理的特別規(guī)定 ,從而對(duì)規(guī)范保險(xiǎn)合同關(guān)系、強(qiáng)化保險(xiǎn)代理責(zé)任將產(chǎn)生積極的作用。認(rèn)真研究《保險(xiǎn)法》中的表見(jiàn)代理行為與民事合同的差別 ,對(duì)于準(zhǔn)確適用《保險(xiǎn)法》有十分重要的意義。
[Abstract]:Apparent agency system is a legal system established in the condition of market economy developing to a certain extent, agency relations becoming more and more complicated and disputes frequent, in order to ensure the security of transactions and protect the legitimate interests of bona fide third parties.Although its establishment has been disputed several times, it has been approved and approved by the theoretical and legislative circles. Therefore, the contract Law stipulates the apparent agency first, which plays an important role in the improvement and development of the agency system.The new Insurance Law adds special provisions of apparent agency, which will play a positive role in standardizing insurance contract relations and strengthening insurance agency liability.It is very important to study the difference between agency behavior and civil contract in Insurance Law.
