【摘要】：人格權(quán)法除需與民法總則、侵權(quán)責(zé)任法相銜接外,還需與合同法銜接。人格尊嚴(yán)保護(hù)與消極締約自由存在沖突,兩者的平衡應(yīng)以我國(guó)現(xiàn)有相關(guān)法律規(guī)定和實(shí)踐為基礎(chǔ),借鑒域外立法經(jīng)驗(yàn)來(lái)實(shí)現(xiàn)。人格權(quán)的限制、轉(zhuǎn)讓以及行使方式的規(guī)定對(duì)合同的效力認(rèn)定在路徑與結(jié)果兩方面存在影響。完善債務(wù)不履行侵害人格權(quán)的損害賠償制度需明確規(guī)定賠償項(xiàng)目、合理界定可預(yù)見(jiàn)性規(guī)則的適用范圍。人格權(quán)商業(yè)化利用的合同法規(guī)制路徑將妨礙其制度內(nèi)容表達(dá),人格權(quán)法的規(guī)制路徑則更為可行。人格權(quán)法屬于民法典的重大創(chuàng)新且缺乏足夠先例可循,立法應(yīng)關(guān)注并慎重處理人格權(quán)法與其他法律制度的互動(dòng)關(guān)系。
[Abstract]:In addition to the general principles of civil law and the law of tort liability, the law of personality rights should be connected with the law of contract. There is a conflict between the protection of human dignity and the freedom of negative contracting. The balance between the two should be based on the existing relevant legal provisions and practices in China. Draw lessons from the experience of foreign legislation to realize the restriction of personality right, The provisions of transfer and exercise mode have an impact on the validity of the contract in both path and result. To perfect the system of damages for non-performance of debts infringing on personal rights, it is necessary to clearly stipulate the compensation items. Reasonable definition of the scope of application of the rules of predictability. The path of the regulation of the commercial use of personality rights will hinder the expression of its system content. The regulation path of personality right law is more feasible. Personality right law belongs to the important innovation of civil code and lacks enough precedent to follow. The legislation should pay attention to and carefully deal with the interactive relationship between personality right law and other legal systems.
