論經(jīng)濟(jì)性裁員的法律規(guī)制

【摘要】:我國經(jīng)濟(jì)性裁員的法律規(guī)范在《勞動法》中得以體現(xiàn),并于《勞動合同法》中得到修正與補(bǔ)充,其目的不外乎在確保勞動者權(quán)益的同時,更注重對社會安定性的考慮?陀^上說,裁員是企業(yè)應(yīng)對經(jīng)濟(jì)形勢變化的一種經(jīng)營選擇,有其存在的合理性,然而,就裁員的結(jié)果看,其不僅會導(dǎo)致大量勞動者失業(yè),嚴(yán)重時甚至可能對社會秩序產(chǎn)生很大壓力,增加社會不和諧的因素,因此,,如何通過裁員制度的設(shè)計(jì)來協(xié)調(diào)勞動者、用人單位與社會三方的利益,促進(jìn)勞企利益最大化、維護(hù)社會穩(wěn)定是勞動法制的重要命題。 本文共分為四個部分。 第一部分介紹經(jīng)濟(jì)性裁員的一般理論。該部分介紹了經(jīng)濟(jì)性裁員的概念、特征,并分析論證了法律規(guī)制經(jīng)濟(jì)性裁員的正當(dāng)性。第二部分介紹了發(fā)達(dá)國家和地區(qū)的經(jīng)濟(jì)性裁員制度。該部分在窺視各國經(jīng)濟(jì)性裁員法律規(guī)范的同時也對相應(yīng)的理論及其制度背景做了簡要的闡釋,并在此基礎(chǔ)上總結(jié)了各國裁員法制的共同特征及對我國的啟示。第三部分對我國經(jīng)濟(jì)性裁員法律規(guī)范進(jìn)行了分析。梳理了我國《勞動合同法》以及《企業(yè)經(jīng)濟(jì)性裁減人員的規(guī)定》的相關(guān)規(guī)定,進(jìn)而從裁員事由、裁員程序、被裁減人員的保護(hù)等方面詳細(xì)剖析了我國當(dāng)前經(jīng)濟(jì)性裁員規(guī)范中所存在的疏漏。第四部分對我國經(jīng)濟(jì)性裁員制度提出改進(jìn)建議。該部分分析指出當(dāng)前我國經(jīng)濟(jì)性裁員法律規(guī)制上的不夠完善,主要源于權(quán)力的制約無效且模糊,因此,應(yīng)在裁員的合法性控制、裁員法律程序、裁員事由、被裁減人員的保護(hù)上盡可能做到明確、周詳。
[Abstract]:China's economic layoffs legal norms embodied in the "labor law", and amended and supplemented in "labor contract law", the purpose is to ensure the rights and interests of the workers at the same time, pay more attention to social stability considerations. Objectively speaking, downsizing is a business enterprise to deal with the economic choice the potential change of the rationality of its existence, however, on the results of layoffs, which will not only lead to a large number of workers unemployed, even may cause great pressure on the social order, increase social disharmony factors, therefore, how to design the system through layoffs to coordinate the employee, the employer and the social three party the interests of laborenterprises maximize interests, maintaining social stability is an important proposition of labor law.
This article is divided into four parts.
The first part describes the general theory of economic layoffs. This part introduces the concept, characteristics of economic layoffs, and analyzes the legitimacy of legal regulation of economic layoffs. The second part introduces the developed countries and the region's economic layoffs system. In this part of the world economic or legal norms but also for layoffs corresponding theoretical and institutional background to do a brief explanation, and on the basis of summarizing the common feature of countries in layoffslegal system and Its Enlightenment to China. The third part analyzes the legal norms of China's economic layoffs. Combed our country < Labor Contract Law > and < enterpriseeconomy cutting staff regulations the relevant provisions, and then lay off the subject, layoff procedures, protection and other aspects of downsizing is a detailed analysis of China's current economic layoffs are norms of omission. The fourth part of our economy Layoff suggestions for improvement. This part of the analysis pointed out that China's current economic layoffs on the legal regulation is not perfect, mainly due to the constraints of the power is invalid and therefore should be fuzzy, the legitimacy of layoffs, layoffs, layoffs reasons, legal procedures, protected personnel reductions as possible clear and comprehensive.
