【摘要】：融資租賃,又稱設(shè)備租賃或現(xiàn)代租賃,是指實(shí)質(zhì)上轉(zhuǎn)移與資產(chǎn)所有權(quán)有關(guān)的全部或大部分風(fēng)險(xiǎn)和報(bào)酬的租賃。融資租賃自上世紀(jì)80年代引入中國(guó)以來(lái),呈現(xiàn)出高速發(fā)展的態(tài)勢(shì),但是其相關(guān)立法依然相對(duì)滯后。如何參考、運(yùn)用合同法和融資租賃相關(guān)司法解釋,對(duì)于我們的實(shí)務(wù)性工作就顯得尤為重要。
[Abstract]:Financial lease, also known as equipment lease or modern lease, refers to the lease that substantially transfers all or most of the risks and rewards related to the ownership of assets. Finance lease has been introduced into China since -20s. However, the relevant legislation is still relatively lagging behind. How to use contract law and financial leasing related judicial interpretation is particularly important for our practical work.
