文章摘要：國(guó)際法碎片化與國(guó)際法多元化是同一問題的不同表象。當(dāng)今全球化背景下的國(guó)際法碎片化不過就是早己存在的特點(diǎn)擴(kuò)大化。碎片化固然從一定程度上消耗了國(guó)際法體制內(nèi)的資源分配，并從一定程度上影響了國(guó)際法作為一個(gè)大體系的綜合效力，但該影響遠(yuǎn)還沒有到達(dá)危害國(guó)際法體系綜合效力和各分支效力的程度�，F(xiàn)有國(guó)際法體系內(nèi)的各種規(guī)則，包括國(guó)家條約義務(wù)，國(guó)際私法規(guī)則和國(guó)際條約解釋規(guī)則等都能從不同角度化解或減輕碎片化引起的困難。只有當(dāng)碎片化所導(dǎo)致的矛盾開始實(shí)質(zhì)性地危害國(guó)家利益時(shí)，國(guó)家才會(huì)作出合理應(yīng)對(duì)的博弈選擇，，以解決碎片化問題。而學(xué)界的使命之一是前瞻性地研究國(guó)際法碎片化的相關(guān)問題，并為國(guó)際社會(huì)需要解決碎片化問題提供有效的應(yīng)對(duì)建議。為此目的，通過聯(lián)合國(guó)相關(guān)機(jī)構(gòu)協(xié)調(diào)不同國(guó)際法分支的規(guī)則是減少和避免碎片化對(duì)國(guó)際法體系沖擊的有效手段之一。

Abstr：Fragmentation of international law is a different face of pluralization of international law. The present phenomenon of fragmentation is nor more than an extended version of long existing features of fragmentation of international law in the era of globalization. Fragmentation to some extent has undoubtedly wasted some shared resources in the system of international law, and has to some extent undermined the synthesized effect of international law as a comprehensive system. However, such negative impacts have not reached such a level so much to endanger the validity of either the entire international law .system or the branch of international law. Various rules of present international law, including state treaty obligations, private interna- tional law and treaty interpretation, help us to resolve and alleviate difficulties of fragmentation from different perspectives. States are the players to resolve problems of international law. Only when the controversies caused by fragmentation begin to substantively endanger national interests, will the states make reasonable gaming option to combat the issue of fragmentation. The mission of academic is to study the relevant issues of fragmentation with forward thinking, and provide effective measures to deal with issues of fragmentation for international society. For such purpose, coordination of different rules of international law branches through the relevant institution of the United Nations is one of the effective ways to reduce and avoid negative im- pacts of fragmentation to the system of international law.
