聯(lián)合國與否決“廢除或改革”

確定和實施國際法肯定會給政治和經濟秩序以及各國之間在意識形態(tài)方面的相互諒解帶來影響。為此,國際生活的其它領域才形成了現有的局面。變革國際法中的一些主要概念已被開始提到了議事日程上來了。眾所周知,傳統(tǒng)法學家如(Grotius,Vattle,Emanuel,Oppenheim and others)等人,他們是將傳統(tǒng)法的主要原則建立在國與國之間自愿交往和平等基礎之上的。自那時起,國際法總則,如國家主權,互不干涉內政等原則才得以確定下來。同樣,聯(lián)合國是依據其憲章于1945年成立的,該憲章是建立在諸多業(yè)已成為國際法中具有約束力的總則的原則基礎之上的。見憲章第二條。 如果說,聯(lián)合國的作用是賦予安理會決議以國際合法性,那么至少應該對這些“國際合法性”加以討論并體現在決議當中。但是,安理會功能的膨脹是以犧牲聯(lián)合國其它機構的功能為代價的。從而使其變成了類似泛世界政府或對其它政府和國家加以監(jiān)督的機構,這意味著取消了世界其它國家的作用,意味著世界只能卷入一場應有盡有的強人和窮人群體之間的激烈沖突,由此而引發(fā)了集團化,局勢緊張化和某些反作用力,借以表達弱者對現實的不滿和他們對這種國際關系模式的杯葛,...
