確定和實(shí)施國(guó)際法肯定會(huì)給政治和經(jīng)濟(jì)秩序以及各國(guó)之間在意識(shí)形態(tài)方面的相互諒解帶來影響。為此,國(guó)際生活的其它領(lǐng)域才形成了現(xiàn)有的局面。變革國(guó)際法中的一些主要概念已被開始提到了議事日程上來了。眾所周知,傳統(tǒng)法學(xué)家如(Grotius,Vattle,Emanuel,Oppenheim and others)等人,他們是將傳統(tǒng)法的主要原則建立在國(guó)與國(guó)之間自愿交往和平等基礎(chǔ)之上的。自那時(shí)起,國(guó)際法總則,如國(guó)家主權(quán),互不干涉內(nèi)政等原則才得以確定下來。同樣,聯(lián)合國(guó)是依據(jù)其憲章于1945年成立的,該憲章是建立在諸多業(yè)已成為國(guó)際法中具有約束力的總則的原則基礎(chǔ)之上的。見憲章第二條。 如果說,聯(lián)合國(guó)的作用是賦予安理會(huì)決議以國(guó)際合法性,那么至少應(yīng)該對(duì)這些“國(guó)際合法性”加以討論并體現(xiàn)在決議當(dāng)中。但是,安理會(huì)功能的膨脹是以犧牲聯(lián)合國(guó)其它機(jī)構(gòu)的功能為代價(jià)的。從而使其變成了類似泛世界政府或?qū)ζ渌蛧?guó)家加以監(jiān)督的機(jī)構(gòu),這意味著取消了世界其它國(guó)家的作用,意味著世界只能卷入一場(chǎng)應(yīng)有盡有的強(qiáng)人和窮人群體之間的激烈沖突,由此而引發(fā)了集團(tuán)化,局勢(shì)緊張化和某些反作用力,借以表達(dá)弱者對(duì)現(xiàn)實(shí)的不滿和他們對(duì)這種國(guó)際關(guān)系模式的杯葛,...
