【摘要】：戰(zhàn)爭,從它的本質(zhì)來講,其發(fā)生必然會伴隨著不幸與悲劇的上演。平民生命安全受到威脅,財產(chǎn)安全無法得到保障,這些都是戰(zhàn)爭帶來損害的具體表現(xiàn)。然而這些并非戰(zhàn)爭所造成破壞的全部。我們需要注意到的是,戰(zhàn)爭所造成的破壞并非局限于對人類及其財產(chǎn)的直接打擊,很多時候,尤其是在冷兵器時代之后,這種破壞的客體常�？梢匝由熘寥祟愘囈陨娴沫h(huán)境。近年來,隨著科學(xué)技術(shù)尤其是軍事科學(xué)技術(shù)的發(fā)展,因戰(zhàn)爭或其他形式武裝沖突造成的環(huán)境破壞已呈現(xiàn)日益嚴重的趨勢。永無休止的戰(zhàn)爭所造成的環(huán)境破壞不僅威脅著現(xiàn)世人類的生命,基于其持續(xù)時間長的特性,后世代人類的生命健康也同樣會受到來自于其的消極影響。因此,對于環(huán)境的保護,不僅僅是在和平時代情境下亟待解決的要務(wù),在戰(zhàn)爭過程中其同樣具備十分重要的地位和意義。目前,在國際法的范疇中,具備一個以國際人道主義法、國際人權(quán)法、國際環(huán)境法以及國際刑法為主,共同構(gòu)成的戰(zhàn)時環(huán)境保護法律框架體系。為了更好地對戰(zhàn)時環(huán)境進行保護,學(xué)者們對目前的戰(zhàn)時環(huán)境保護法律框架體系已經(jīng)開展了諸多研究,其中一些研究展現(xiàn)了卓越的學(xué)術(shù)見解并得出了極具啟發(fā)意義的研究成果。然而,在現(xiàn)存的關(guān)于此問題的研究中,絕大部分研究僅僅從戰(zhàn)時環(huán)境保護法律框架體系中一個特定的分支來進行分析,而非將整個法律框架體系作為一個整體進行全面的分析研究。盡管目前也存在部分針對此領(lǐng)域的研究,已經(jīng)將前文所述法律框架中的所有分支包含在分析研究范圍內(nèi),然而隨著現(xiàn)代軍事及科技的飛速發(fā)展,一些已有的研究成果無法適應(yīng)新環(huán)境的挑戰(zhàn),亟待更新。本篇論文通過定性研究及案例分析相結(jié)合的傳統(tǒng)研究方法,針對目前國際法范疇下的戰(zhàn)時環(huán)境保護法律框架體系進行完整地分析和研究。本篇論文的定性研究部分主要通過對文獻、政府報告、機構(gòu)報告、學(xué)術(shù)報告等的綜合分析而進行。本篇論文的案例研究部分則選取了具有不同時代代表性的三個經(jīng)典案例進行分析和研究,它們分別是：越南戰(zhàn)爭,海灣戰(zhàn)爭(1990-1991),以及目前正在進行的敘利亞戰(zhàn)爭。結(jié)合定性研究所分析得到的戰(zhàn)時環(huán)境保護法律框架具體內(nèi)容,案例分析針對該法律框架是否能夠充分、有效地保護戰(zhàn)時環(huán)境作出了具體研究。通過研究,我們發(fā)現(xiàn),目前國際法范疇下的戰(zhàn)時環(huán)境保護法律框架體系,無論是從保護方式的角度,還是從執(zhí)行力的角度,都存在著不同程度的漏洞。除上述內(nèi)容之外,本文同時就分析研究而發(fā)現(xiàn)的戰(zhàn)時環(huán)境保護法律框架的不足之處提出了一些可行的解決方案。
