【摘要】：殘疾人權(quán)利及其保護(hù)問題一直受到世界各國人民的關(guān)注。殘疾人保護(hù)事業(yè)的發(fā)展,與國際法的推動有著密切關(guān)系。國際法明確了殘疾人的權(quán)利,糾正了國際社會對殘疾人的錯誤認(rèn)識和陳腐觀念,是保護(hù)和促進(jìn)殘疾人權(quán)利的重要手段。人權(quán)保護(hù)的一般性國際公約和殘疾人權(quán)利保護(hù)的專門性公約,為殘疾人事業(yè)提供了指導(dǎo)性綱領(lǐng)和具體規(guī)范要求。但鑒于國際社會的無政府性和國際法自身的特性,殘疾人權(quán)利的國際法保護(hù)還存在進(jìn)一步提升的空間。未來需要整合現(xiàn)有國際法條文,完善締約國報(bào)告制度,建立健全監(jiān)督機(jī)制,規(guī)范非政府組織作用,進(jìn)一步發(fā)揮殘疾人權(quán)利委員會的建設(shè)性作用。
[Abstract]:The rights of persons with disabilities and their protection have always been concerned by people all over the world. The development of the protection of persons with disabilities is closely related to the promotion of international law. International law defines the rights of persons with disabilities and corrects the misunderstandings and stereotyping of persons with disabilities in the international community. It is an important means of protecting and promoting the rights of persons with disabilities. The general international conventions for the protection of human rights and the special conventions for the protection of the rights of persons with disabilities provide a guiding framework and specific normative requirements for the cause of persons with disabilities. However, in view of the anarchism of the international community and the characteristics of international law itself, there is room for further improvement in the protection of the rights of persons with disabilities in international law. In the future, it is necessary to integrate the existing provisions of international law, improve the reporting system of States parties, establish and improve the monitoring mechanism, regulate the role of non-governmental organizations, and further give full play to the constructive role of the Committee on the Rights of Persons with Disabilities.
