【摘要】：誠實(shí)信用作為一項(xiàng)重要的法律原則,不僅在私法領(lǐng)域具有核心地位,在國際習(xí)慣、國際判例、國際條約中均有所體現(xiàn),構(gòu)成國際公法的一項(xiàng)基本原則。條約的實(shí)施需要誠信,條約當(dāng)事方必須誠信遵守條約,履行條約中的義務(wù)。中國和菲律賓就南海問題簽署、發(fā)表的聯(lián)合聲明、聯(lián)合新聞公報(bào)等雙邊文件以及《南海宣言》等在性質(zhì)上屬于國際法中的條約,菲律賓應(yīng)誠信履行,且仲裁庭2015年做出的《關(guān)于管轄權(quán)和可受理性問題的裁決》及2016年7月12日做出的《裁決書》對(duì)《南海宣言》定性有誤。而且,作為《聯(lián)合國海洋法公約》的締約國,菲律賓沒有按照《聯(lián)合國海洋法公約》關(guān)于爭端解決程序的規(guī)定,單方面將中菲南海爭端提交至仲裁程序,違背誠實(shí)信用原則。
[Abstract]:As an important legal principle, good faith not only plays a core role in the field of private law, but also embodies it in international custom, international precedent and international treaties, which constitutes a basic principle of public international law. The implementation of the treaty requires good faith, and the parties to the treaty must abide by the treaty in good faith and fulfill their obligations under the treaty. Bilateral documents such as the signing, joint statement, joint press release and other bilateral documents on the South China Sea issue, as well as treaties such as the South China Sea Declaration, which belong to international law in nature, should be carried out in good faith by the Philippines, and the Arbitration Tribunal's ruling on jurisdiction and acceptability in 2015 and the award issued on July 12, 2016 are incorrect in the characterization of the South China Sea Declaration. Moreover, as a party to the United Nations Convention on the Law of the Sea, the Philippines has not unilaterally submitted the South China Sea dispute to arbitration proceedings in accordance with the provisions of the United Nations Convention on the Law of the Sea on dispute settlement procedures, contrary to the principle of good faith.
