試論我國知識產(chǎn)權(quán)海關(guān)保護制度及完善

【摘要】：知識產(chǎn)權(quán)海關(guān)保護,又稱知識產(chǎn)權(quán)邊境保護(Border Protection of Intellectual Rights),是指海關(guān)依法制止侵犯知識產(chǎn)權(quán)的貨物進出境的措施。隨著全球化的不斷發(fā)展,國際貿(mào)易中知識產(chǎn)權(quán)的保護問題日益受到各國重視,在發(fā)達國家的主要推動下形成的《與貿(mào)易有關(guān)的知識產(chǎn)權(quán)協(xié)議》(以下簡稱TRIPS協(xié)議),已經(jīng)成為國際貿(mào)易領(lǐng)域的共同法律規(guī)范,對WTO組織各國具有普遍約束力。TRIPS協(xié)議在其“知識產(chǎn)權(quán)的實施”和“與邊境措施相關(guān)的特殊要求”中對知識產(chǎn)權(quán)邊境保護規(guī)定了最低標準和基本程序,并明確賦予海關(guān)“知識產(chǎn)權(quán)邊境保護職能”。為了達到加入WTO的要求和履行成員國的義務(wù),我國在2004年開始逐步建立起自身的知識產(chǎn)權(quán)海關(guān)保護制度體系。本文以探索完善我國知識產(chǎn)海關(guān)保護制度為目的,從完善海關(guān)執(zhí)法制度和程序的角度,首先系統(tǒng)介紹了我國業(yè)已建立起的包括知識產(chǎn)權(quán)海關(guān)備案、申請扣留、調(diào)查處理、貨物處置及責任追究等一整套相對完備的知識產(chǎn)權(quán)海關(guān)保護法律制度。其次,分析比較歐盟和美國知識產(chǎn)權(quán)海關(guān)保護制度的特點,結(jié)合TRIPS協(xié)議的規(guī)定與要求,探討我國知識產(chǎn)權(quán)海關(guān)保護制度在執(zhí)法透明度問題、簡易便捷程序設(shè)計、歸責原則的確立、防止權(quán)利人權(quán)利濫用以及司法協(xié)調(diào)機制等方面的不足之處,并提出了相應(yīng)的完善措施。希望對進一步完善我國知識產(chǎn)權(quán)海關(guān)保護制度,提高海關(guān)監(jiān)管能力尤其是一線執(zhí)法海關(guān)的執(zhí)法水平有所裨益。
[Abstract]:The protection of intellectual property, also known as the Border Protection of Intellectual Property Rights, means the measures to stop the entry and exit of goods infringing intellectual property by the Customs in accordance with the law. With the development of globalization, the protection of intellectual property in international trade is becoming more and more important, and the trade-related intellectual property rights agreement (TRIPS Agreement), which is formed by the major promotion of the developed countries, has become a common legal norm in the field of international trade. It is generally binding on the countries of the WTO. The TRIPS Agreement provides minimum standards and basic procedures for intellectual property border protection in its "Implementation of intellectual property" and "Special requirements related to border measures" and has clearly given the customs "intellectual property border protection function". In order to meet the requirements of China's accession to the WTO and to fulfill its obligations, our country began to set up its own intellectual property customs protection system in 2004. In order to improve the customs protection system of our country, this paper, from the angle of perfecting the customs law enforcement system and procedure, firstly introduces the establishment of the customs file of the intellectual property right which has been set up in our country, the application for the detention and the investigation and treatment, A complete set of relatively complete legal system for the protection of intellectual property, such as the disposition of goods and accountability. Secondly, the paper analyzes the characteristics of the customs protection system of intellectual property in the European Union and the United States, and discusses the establishment of the customs protection system of intellectual property in China in the aspects of law enforcement transparency, the simple and convenient program design and the principle of imputation in combination with the provisions and requirements of the TRIPS Agreement. To prevent the abuse of rights and the mechanism of judicial coordination, and put forward corresponding measures. It would be helpful to further improve the customs protection system of intellectual property in our country, improve the customs supervision ability, especially the law enforcement level of the first-line law enforcement customs.
