【摘要】：《巴黎協(xié)定》是各國應(yīng)對(duì)氣候變化所產(chǎn)生的具有里程碑意義的公約成果,但在氣候有益技術(shù)轉(zhuǎn)讓方面的條款作了模糊化處理,相關(guān)知識(shí)產(chǎn)權(quán)議題仍未達(dá)成共識(shí)。如何利用現(xiàn)有知識(shí)產(chǎn)權(quán)國際保護(hù)與合作機(jī)制,提高發(fā)達(dá)國家向發(fā)展中國家進(jìn)行氣候有益技術(shù)轉(zhuǎn)讓的實(shí)質(zhì)效果、幫助發(fā)展中國家完成減排目標(biāo),將成為未來全球氣候變化知識(shí)產(chǎn)權(quán)問題談判的關(guān)鍵。從知識(shí)產(chǎn)權(quán)對(duì)氣候有益技術(shù)轉(zhuǎn)讓的影響、發(fā)達(dá)國家與發(fā)展中國家在氣候有益技術(shù)領(lǐng)域的合作障礙、《TRIPS協(xié)定》知識(shí)產(chǎn)權(quán)彈性條款的適用等角度出發(fā),對(duì)《巴黎協(xié)定》后氣候有益技術(shù)的知識(shí)產(chǎn)權(quán)國際合作前景進(jìn)行分析,并以中美兩國在清潔技術(shù)領(lǐng)域知識(shí)產(chǎn)權(quán)合作創(chuàng)新模式為例,探討發(fā)達(dá)國家向發(fā)展中國家氣候轉(zhuǎn)讓有益技術(shù)及加強(qiáng)南南合作的可行模式。
[Abstract]:The Paris Agreement is a landmark convention for States to address climate change, but the provisions of climate-benefit technology transfer have been fuzzified, and there is still no consensus on the issue of intellectual property rights. How to make use of the existing international protection and cooperation mechanism of intellectual property, to improve the substantial effect of developed countries to climate-beneficial technology transfer to developing countries, and to help developing countries to achieve their emission reduction targets, will be the key to the future negotiations on global climate change intellectual property. from the point of view of the impact of intellectual property on climate-benefit technology transfer, barriers to cooperation between developed and developing countries in the area of climate-benefit technology, the application of the TRIPS Agreement and the elastic provisions of intellectual property, Based on the analysis of the international cooperation prospects of the intellectual property rights of the "Paris Agreement", and taking the innovation model of intellectual property cooperation between the two countries in the field of clean technology as an example, the feasible model of the developed countries to transfer the beneficial technologies to the climate transfer in developing countries and to strengthen the South-South cooperation should be discussed.
