【摘要】：近年來,隨著產(chǎn)業(yè)分工全球化,危險貨物海上跨界運輸已變得越來越普遍,于是出現(xiàn)了與此相關(guān)的一系列法律爭議。從危險貨物的法律性質(zhì)出發(fā),可以將危險貨物分為禁止運輸?shù)奈ｋU貨物、特殊危險貨物、普通危險貨物三類,分別討論其對應(yīng)的沿海國管轄權(quán)問題。針對不同種類的危險貨物,沿海國應(yīng)采取不同的管轄措施,嚴(yán)格管控禁止運輸之危險貨物的海上運輸,規(guī)范針對運輸特殊危險貨物的事前告知制度,嚴(yán)格監(jiān)督且加強對普通危險貨物的海上跨界運輸?shù)墓芾怼?br/>[Abstract]:In recent years, with the globalization of industrial division of labor, the cross-border transport of dangerous goods by sea has become more and more common, so a series of related legal disputes have emerged. According to the legal nature of dangerous goods, dangerous goods can be divided into three categories: prohibited dangerous goods, special dangerous goods and ordinary dangerous goods, and the corresponding jurisdiction of coastal States can be discussed respectively. For different types of dangerous goods, coastal States shall take different jurisdiction measures, strictly control the maritime transport of prohibited dangerous goods, and standardize the system of prior notification for the transport of special dangerous goods, Strictly supervise and strengthen the management of the cross-border transport of ordinary dangerous goods by sea.
