【摘要】：海盜這一社會(huì)現(xiàn)象由來已久，國際社會(huì)為防范和打擊海盜一直在堅(jiān)持不懈地努力著，特別是在制定懲治海盜的法律規(guī)則方面作出了很大努力。近年來，索馬里海盜猖獗的行為使人們?cè)俅侮P(guān)注這一海盜問題，聯(lián)合國安理會(huì)相繼通過了一系列決議，呼吁世界各國聯(lián)合起來為打擊海盜進(jìn)行努力。 索馬里海盜之所以會(huì)如此猖獗，有其特定的根源，是當(dāng)前索馬里國內(nèi)現(xiàn)狀的一個(gè)真實(shí)寫照，反映了這個(gè)國家在人道、政治、經(jīng)濟(jì)等各方面都存在危機(jī)。打擊海盜的行動(dòng)，離不開國際社會(huì)的通力合作，尤其是隨著索馬里海盜活動(dòng)區(qū)域的不斷擴(kuò)大以及呈現(xiàn)出的新特點(diǎn)也越來越需要國際合作。通過分析打擊索馬里海盜國際合作現(xiàn)狀可以發(fā)現(xiàn)面臨著諸多困境。 本文主要就打擊索馬里海盜的國際合作法律機(jī)制這一問題進(jìn)行探討，重點(diǎn)分析當(dāng)前國際合作機(jī)制的現(xiàn)狀，指出其中存在的問題，然后運(yùn)用國際合作與國際機(jī)制的基礎(chǔ)理論，，并結(jié)合當(dāng)前打擊海盜國際合作需要，對(duì)如何完善打擊索馬里海盜國際合作法律機(jī)制作深入探討。 第一部分，“打擊索馬里海盜的緣起”。在全面分析了索馬里海盜崛起的過程以及為何如此猖獗的原因的基礎(chǔ)上，指出了索馬里海盜呈現(xiàn)出新的發(fā)展趨勢(shì)使國際社會(huì)面臨不同程度的威脅和挑戰(zhàn)，其對(duì)國際社會(huì)所造成的威脅甚至超出了我們的想象，急需國際社會(huì)合作以共同應(yīng)對(duì)。 第二部分，“國際合作機(jī)制在打擊索馬里海盜中的重要性”。簡(jiǎn)要闡述了國際合作與國際機(jī)制基礎(chǔ)理論。接著分析了國際合作機(jī)制在打擊索馬里海盜中的作用。 第三部分，“打擊索馬里海盜國際合作機(jī)制現(xiàn)狀分析”。先是分析了國際合作打擊索馬里海盜的立法現(xiàn)狀和現(xiàn)有舉措，接著指出在現(xiàn)行的打擊索馬里海盜國際合作機(jī)制中面臨的困境。 第四部分，“完善打擊索馬里海盜國際合作法律機(jī)制的思考”。就當(dāng)前國際合作機(jī)制中存在的問題，并結(jié)合當(dāng)前打擊海盜國際合作需要，積極探討促進(jìn)合作應(yīng)對(duì)索馬里海盜更新發(fā)展的新思路。
[Abstract]:Piracy has a long history, and the international community has been making unremitting efforts to prevent and combat piracy, especially in the formulation of legal rules to punish pirates. In recent years, the rampant piracy in Somalia has once again made people pay attention to this piracy problem. The United Nations Security Council has adopted a series of resolutions calling on all countries in the world to work together to combat piracy. The reason why Somali pirates are so rampant has its specific root causes, which is a true portrayal of the current situation in Somalia, reflecting the crisis in the country in terms of humanity, politics, economy and so on. Anti-piracy operations can not be separated from the full cooperation of the international community, especially with the continuous expansion of Somali piracy areas and the emergence of new characteristics also increasingly need international cooperation. Through the analysis of the current situation of international cooperation against Somali piracy, we can find that we are facing many difficulties. This paper mainly discusses the legal mechanism of international cooperation against Somali piracy, focuses on the analysis of the current situation of international cooperation mechanism, points out the existing problems, and then applies the basic theory of international cooperation and international mechanism. Combined with the current needs of international cooperation against piracy, this paper probes into how to improve the legal mechanism of international cooperation against piracy in Somalia. The first part, "the origin of fighting Somali pirates." On the basis of a comprehensive analysis of the process of the rise of Somali pirates and the reasons why they are so rampant, it is pointed out that Somali pirates are facing different degrees of threats and challenges as a result of new trends in the development of Somali pirates, Its threat to the international community is even more than we can imagine, and there is an urgent need for international cooperation to deal with it together. The second part, the importance of international cooperation mechanism in the fight against Somali piracy. This paper briefly expounds the basic theory of international cooperation and international mechanism. Then it analyzes the role of international cooperation mechanism in the fight against Somali pirates. The third part, the analysis of the current situation of the international cooperation mechanism against Somali piracy. This paper first analyzes the current legislative situation and existing measures of international cooperation against Somali piracy, and then points out the difficulties faced in the existing international cooperation mechanism against Somali piracy. The fourth part, "thoughts on perfecting the legal Mechanism of International Cooperation against Somali Piracy". In view of the problems existing in the current international cooperation mechanism and combining with the needs of the current international cooperation against piracy, this paper actively discusses new ideas for promoting cooperation in response to the renewal and development of Somali pirates.
