【摘要】：司法協(xié)助中的中央機(jī)關(guān)聯(lián)系機(jī)制的發(fā)展在一些國(guó)際公約、雙邊條約以及中外國(guó)內(nèi)立法中有較清晰的反映。各國(guó)中央機(jī)關(guān)的設(shè)置,特別是數(shù)量上存在不少差異,客觀上對(duì)于司法協(xié)助在地區(qū)和全球范圍的規(guī)范化和標(biāo)準(zhǔn)化造成了巨大困難。從國(guó)際公約的發(fā)展看,中央機(jī)關(guān)的設(shè)置呈現(xiàn)出統(tǒng)一性趨勢(shì)。目前國(guó)內(nèi)關(guān)于中央機(jī)關(guān)的職能主要包括對(duì)外聯(lián)系、程序性確認(rèn)以及對(duì)內(nèi)協(xié)調(diào)等三個(gè)方面的觀點(diǎn)值得推敲。中央機(jī)關(guān)應(yīng)當(dāng)重點(diǎn)履行輔助決策、服務(wù)執(zhí)法、組織協(xié)調(diào)、實(shí)施監(jiān)督四個(gè)方面的職能。在政治經(jīng)濟(jì)一體化和互信程度較高的歐洲,司法協(xié)助程序的扁平化趨勢(shì)日益明顯,中央機(jī)關(guān)聯(lián)系機(jī)制已經(jīng)遭到前所未有的挑戰(zhàn)。
[Abstract]:The development of central organ contact mechanism in mutual legal assistance is clearly reflected in some international conventions, bilateral treaties and domestic and foreign legislation. There are many differences in the establishment of central organs in various countries, especially in quantity, which objectively causes great difficulties to the standardization and standardization of mutual legal assistance at the regional and global levels. From the development of international conventions, the establishment of central organs shows a unified trend. At present, the functions of central organs mainly include external contact, procedural confirmation and internal coordination. Central organs should focus on supporting decision-making, serving law enforcement, organizing and coordinating, and carrying out supervision. In Europe, where the degree of political and economic integration and mutual trust is high, the flattening trend of mutual legal assistance procedure is becoming more and more obvious, and the contact mechanism of central authorities has been challenged unprecedented.
