【摘要】：二十世紀(jì)中葉開始,伴隨著資源和環(huán)境問題愈加嚴(yán)峻,人類開始反思自己的發(fā)展模式,國際社會(huì)不斷呼吁加強(qiáng)對(duì)環(huán)境和資源的保護(hù),希冀探尋一種經(jīng)濟(jì)發(fā)展與生態(tài)保護(hù)協(xié)調(diào)并進(jìn)的可持續(xù)的發(fā)展模式。在這種歷史背景下,可持續(xù)發(fā)展理念應(yīng)運(yùn)而生,并逐步成為時(shí)代發(fā)展的趨勢(shì)。WTO作為世界上最大的國際貿(mào)易組織,承擔(dān)著發(fā)展國際貿(mào)易的重要使命。為了順應(yīng)時(shí)代的發(fā)展趨勢(shì),推動(dòng)國際貿(mào)易的可持續(xù)發(fā)展,WTO將可持續(xù)發(fā)展寫入序言,以其作為發(fā)展目標(biāo),開啟了國際貿(mào)易可持續(xù)發(fā)展的新紀(jì)元。然而,由于可持續(xù)發(fā)展并非是WTO法律體系中固有理念,盡管WTO法對(duì)它做出了積極的回應(yīng),但可持續(xù)發(fā)展在WTO法律體系內(nèi)的發(fā)展仍存在著理論和制度上的障礙,需要不斷發(fā)展和完善。本文共分五章對(duì)WTO法與可持續(xù)發(fā)展進(jìn)行研究。第一章對(duì)可持續(xù)發(fā)展理念進(jìn)行梳理,考察其歷史沿革以及在WTO法中的發(fā)展,并就何為可持續(xù)發(fā)展以及研究WTO法中可持續(xù)發(fā)展有何意義展開論述。第二章進(jìn)一步對(duì)WTO法中的可持續(xù)發(fā)展進(jìn)行詳細(xì)的考察,闡述了如今可持續(xù)發(fā)展理念在WTO法中的地位,并且就可持續(xù)發(fā)展理念公平以及環(huán)境與資源保護(hù)的兩個(gè)重要內(nèi)容在WTO法中的實(shí)現(xiàn)情況進(jìn)行了闡述。第三章重點(diǎn)從法理的角度研究了當(dāng)前WTO法律體系中可持續(xù)發(fā)展所面臨的障礙,包括理論的局限性以及綠色貿(mào)易壁壘、與多邊環(huán)境協(xié)議沖突等制度上的障礙。在此基礎(chǔ)上,第四章對(duì)WTO法中的可持續(xù)發(fā)展提出了展望,著手從理論框架以及制度層面對(duì)其進(jìn)行完善。第五章則對(duì)中國如何在WTO法律框架內(nèi)實(shí)現(xiàn)對(duì)外貿(mào)易的可持續(xù)發(fā)展進(jìn)行探討,主要考察了中國可持續(xù)發(fā)展的立法現(xiàn)狀,并且對(duì)中國入世后如何實(shí)現(xiàn)對(duì)外貿(mào)易的可持續(xù)發(fā)展提出了展望。
[Abstract]:Since the middle of the twentieth century, with the increasingly serious problems of resources and the environment, mankind has begun to reflect on its own development model, and the international community has continuously called for the strengthening of the protection of the environment and resources. It is hoped to explore a sustainable development mode which coordinated economic development and ecological protection. Under this historical background, the concept of sustainable development emerges as the times require, and gradually becomes the trend of the times. As the largest international trade organization in the world, WTO undertakes the important mission of developing international trade. In order to conform to the development trend of the times and promote the sustainable development of international trade, WTO has written the sustainable development into the preface, taking it as the development goal, and opened the new era of the sustainable development of international trade. However, since sustainable development is not an inherent concept in the legal system of WTO, there are still theoretical and institutional obstacles to the development of sustainable development in the legal system of WTO, although it has made a positive response to it. It needs continuous development and improvement. This paper is divided into five chapters to study the WTO method and sustainable development. The first chapter reviews the concept of sustainable development, examines its historical evolution and development in WTO law, and discusses what is sustainable development and what is the significance of studying sustainable development in WTO law. The second chapter makes a detailed investigation on the sustainable development of the WTO method, and expounds the position of the concept of sustainable development in the WTO law. The realization of the concept of sustainable development equity and environment and resource protection in WTO is also discussed in this paper. The third chapter focuses on the legal perspective of the current legal system of WTO facing obstacles to sustainable development, including theoretical limitations, green trade barriers, conflicts with multilateral environmental agreements and other institutional barriers. On this basis, the fourth chapter puts forward the prospect of the sustainable development of the WTO method, and starts to perfect it from the theoretical framework and the system level. The fifth chapter discusses how to realize the sustainable development of foreign trade in China within the framework of WTO law, and mainly examines the current legislative situation of China's sustainable development. It also puts forward the prospect of how to realize the sustainable development of foreign trade after China's entry into WTO.
